PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)
Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted-
(aa) damaging the offices of the Conservative Party in an explosion;
and
(bb) the unlawful possession of explosives, committed at or near Roodepoort,
Gauteng, on or about 19 April 1993;
(aa) arson in relating to of government vehicles;
(bb) arson relating to government school buildings, committed at or
near Sibasa Area, Venda, during or about June 1976 ;
(cc) terrorism as set out in Pietersburg Magistrate's Court Case No.
RC 166/78; and
(dd) sabotage as set out in Pietersburg Magistrate's Court Case No.RC
63/92;
(aa) damaging the offices of the Conservative Party in an explosion;
and
(bb) the unlawful possession of explosives, committed at or near Roodepoort,
Gauteng, on or about 19 April 1993;
(aa) the attack on members of the SADF, committed at or near the corner
of John Brand Street and 16' Avenue, Alexandra Township, Johannesburg,
on or about 16 December 1986;
(bb) the attack on members of the SADF, committed, at or near the corner
of John Brand Street and 16th Avenue, Alexandra Township, Johannesburg,
on or about 1 January 1987;
(cc) the attack on members of the SADF, committed, at or near the corner
of Hofmeyer Street and 11 t" Avenue, Alexandra Township, Johannesburg,
on or about the end of January beginning February 1987; and
(dd) the unlawful possession of firearms and ammunition;
(aa) the malicious damage caused to the Zola Municipality Offices,
committed at or near Soweto on or about 21 November 1987;
(bb) the illegal possession of explosives, committed on or about 21
November 1987;
(cc) the attempted murder of FANIE STEPHEN MANGOANE, MOROKA EDWARD RAMETSE,
PHATSA PHILEMON KEKANA and RAYMOND KGWEDI;
(dd) the illegal possession of an AK 47 and ammunition, committed at
or near Moemise Street, Zone 2, Meadowlands, on or about 29 January
1988;
(ee) the attempted murder of Municipal Police Force members in or near
Emdeni during or about April or May 1988; and
(ff) the illegal possession of firearms and ammunition;
(aa) the killing of THOLINHLANHLA BLESSING MABASO, THABANI BRIAN MEMELA,
LUVUYO ANGELIUS PERCIVAL MGOBOZI and MBONGENI HENRY ZONDI,
(bb) the unlawful possession of arms, ammunition and hand-grenades;
and defeating and obstructing the ends of justice, committed at or near
the Quarry Road off-ramp on the southbound N2 Highway, Durban, on or
about 7 September 1986;
(aa) the murder of MATHEUS GIDEON PALVIE,
(bb) the illegal possession of a 6.35mm pistol in contravention of Section
2 of the Arms and Ammunition Act, 1969, (Act 75 of 1969)
(cc) the illegal possession of a .22 rifle;
(dd) the illegal possession of ammunition; and
(ee) the malicious damage of the property of MG PALVIE namely a motor
vehicle, registration no. CAT12884, committed at or near Cradock on
or about 6 February 1987;
(aa) the kidnapping and subsequent murder of a Mr ZULU; and
(bb) the unlawful possession of an AK47 firearms and ammunition;
(aa) an undetermined number of attempted murders, committed during
1992; and
(bb) the unlawful possession of a R4 rifle and a AK 47 firearm and ammunition,
committed towards the end of 1992, at or near Schoeman Street, Pretoria;
(aa) the unlawful possession of an AK 47 firearm; and
(bb) attempted murder of an unidentified person, committed during or
about April 1994;
(aa) the kidnapping of SIBONGILE SAMBO and her sibling; and
(bb) the murdering of SIBONGILE SAMBO, committed during 1993 at or near
Danza Zone, Thokoza;
(aa) the attempted murder of SIBONGILE SAMBO;
(bb) arson relating to the house of SIBONGILE SAMBO;
(cc) the kidnapping of SIBONGILE SAMBO;
(dd) the murder of SIBONGILE SAMBO; and
(ee) the illegal possession of a firearm and ammunition, committed at
or near Danza Zone, Thokoza, during 1993;
(aa) the attempted murder of SIBONGILE SAMBO;
(bb) arson relating to the house of SIBONGILE SAMBO; and
(cc) the kidnapping of SIBONGILE SAMBO, committed at or near Danza Zone,
Thokoza, during 1993;
(aa) the attempted murder of SIBONGILE SAMBO;
(bb) arson relating to the house of SIBONGILE SAMBO;
(cc) the murder of SIBONGILE SAMBO; and (dd) arson relating to the house
of a Mr MAZIBUKO, committed at or near Danza Zone, Thokoza, during 1993;
(aa) the attempted murder of Abraham MZIZI; and
(bb) arson relating to the house of Abraham MZIZI, committed during
1990;
(aa) the kidnapping of SIPHO MAKHATINI;
(bb) the murder of SIPHO MAKHATINI; and
(cc) the unlawful possession of an AK 47 and the ammunition used in
the commission of the offences;
(aa) the attempted murder of an undetermined number of unidentified
people; and
(bb) the unlawful distribution and possession of an undetermined number
of firearms and explosives, and of an undetermined amount of ammunition,
committed in or near Thokoza, during or about September 1990;
(aa) the kidnapping of an unidentified person; and
(bb) the unlawful dealing in, and distribution and possession of, an
undetermined amount of ammunition, committed during the period 1993
to 1994;
(aa) robbery of the motor vehicle belonging to a Mr TSHABALALA;
(bb) the unlawful possession of an undetermined number of firearms and
of an undetermined amount of ammunition;
(cc) the unlawful transportation and distribution of an undetermined
number of firearms and of an undetermined amount of ammunition;
(dd) the murder of GLEN THOMPSON;
(ee) the attempted murder of a Mr GEHLIG, committed at or near Dawn
Park;
(ff) robbery of an undetermined number of firearms and of an undetermined
amount of ammunition;
(gg) the unlawful possession of an undetermined number of firearms and
of an undetermined amount of ammunition; and
(hh) the unlawful transportation and distribution of an undetermined
number of firearms and ammunition, committed at or near Klipriver Police
Station;
(aa) housebreaking with the intention to rob and robbery with aggravating
circumstances;
(bb) the attempted murder of ANDRIES JOHANNES JACOBUS VAN TONDER and
INA VAN TONDER; and
(cc) the illegal possession of firearms, committed on a farm at or near
Maselspoort on or about 10 February 1991;
(aa) the murder of JOHANNES THEODORUS KEMP;
(bb) the attempted murder of SUNELLE ELIZE LOURENS;
(cc) the attempted murder of ADINE LEIGH ANNE PEARCE
dd) the attempted murder of ALBERTO DE ARZICH MAGALHAES DE LIMA;
(ee) the attempted murder of RYAN CHRISTOPHER KRUGER;
(ff) the attempted murder of FLORETTA YORK; and
(gg) the attempted murder of MARIA LOWERDIS, committed at or near Durban
on or about 9 October 1990;
(aa) all offences and delicts arising from the operations of the De
Lange MK unit (Broederstroom Unit) committed during or about the period
1986 to 1988;
(bb) the attack on the communications tower committed at or near Linksfield
Ridge, Johannesburg, during or about November 1987; and
(cc) the attack on a South African Airforce bus, committed at or near
Benoni on or about 1 March 1988;
(aa) all of the operations of the DE LANGE MK unit and in particular the following offences of the unit, committed during or about the period 1986 to 1988;
(aa) terrorism in contravention of Section 54(1) of Act 74 of 1982
relating to receiving military training in exile.
(bb) terrorism in respect of infiltrating and deploying an MK unit inside
South Africa;
(cc) terrorism in respect of the equipping, receiving and possession
of weapons, ammunition, explosives and accessories;
(dd) terrorism in respect of the explosion at the high voltage mast
pole in Kliprivier;
(ee) terrorism in respect of the explosion at the communications mast
antennae;
(ff) terrorism in respect of the explosion near the South African Airforce
bus; and
(gg) terrorism in respect of the placing of a limpet mine under a motor
vehicle, committed at or near Johannesburg during or about the period
1986 to 1988;
(aa) terrorism in contravention of Section 54(1) of Act 74 of 1982
relating to receiving military training in exile;
(bb) terrorism in respect of infiltrating and deploying an MK unit inside
South Africa;
(cc) terrorism in respect of the equipping, receiving and possession
of weapons, ammunition, explosives and accessories;
(dd) terrorism in respect of the explosion at the high voltage mast
pole in Kliprivier;
(ee) terrorism in respect of the explosion at the communications mast
antennae; and
(ff) terrorism in respect of conspiracy to attack and an attempted attack
on Randburg Commando Headquarters, committed during or about the period
1986 to 1988;
(aa) the murder of a person known as SCORPIO (and whose real name might
have been OUPA RONALD MADONDO);
(bb) desecration of a corpse, directly linked to the said killing;
(cc) the disposal of the body; and
(dd) any other offence or delict flowing from the murder, committed
on or near the farm Leeuspoort at Candover in the Ngotje district near
the Josini (Pongola) Dam during or about 1980 ;
(aa) the kidnapping of BHEKINHLANHLA GOODLUCK MPUNGOSE, committed at
or near Lusaka on or about 20 May 1987;
(bb) assault with intent to do grievous bodily harm on BHEKINHLANHLA
GOODLUCK MPUNGOSE, committed at or near Lusaka and on or near Congela
Farm during the period 20 May 1987 to 15 July 1987;
(aa) the kidnapping of BHEKINHLANHLA GOODLUCK MPUNGOSE; and
(bb) assault with intent to do grievous bodily harm on BHEKINHLANHLA
GOODLUCK MPUNGOSE, committed at or near Lusaka and on or near Congela
Farm during the period 20 May 1987 to 15 July 1987;
(aa) any offence or delicit committed as camp commander of Camp 32;
and
(bb) the deaths of ZABA MALEDZA and EDWARD MASUKU, committed at or near
Camp 32 during or about 1983 and 1985 ;
(aa) the abduction of and assault on JABULANI SYDNEY MSIBI; and (bb) all offences and delicts directly associated with or flowing from the conspiracy to abduct, committed in or near Swaziland during or about June 1986;
(aa)terrorism in contravention of Section 54 (1) of Act 74 of 1982,
read with Sections 1, 54 (6), 54 (7) and 69 of the said Act, to wit,
placing an explosive device, consisting of 2 (two) 158 Mini-Limpet mines
and 4 (four) SZ-3 demolition charges, at an electricity transformer
in front of the South African Police Radio technical workshop and causing
the device to detonate, causing damage to the said transformer and adjacent
State and private properties, committed at or near Ridge Road, Durban
on or about 28 January 1989;
(bb) terrorism in contravention of Section 54 (1) of Act 74 of 1982
read with Sections 1, 54 (6), 54 (7) and 69 of the said Act, to wit,
placing an explosive device consisting of 2 (two) 158 Mini-Limpet mines
an 4 (four) SZ-3 demolition charges and causing the device to detonate,
causing damage to the adjacent State and private properties, committed
at or near the Natal Command Headquarters of the South African Defence
Force, Marine Parade, Durban, on or about 10 March 1989;
(cc) the explosion, committed at or near the SAP Single Quarters, C.R.
Swart Square, Stanger Street, Durban, on or about 7 April 1989;
(dd) the unlawful possession of hand-grenades and bombs, to wit:
(ee) the unlawful possession of machine guns or machine rifles and/or parts thereof, to wit:
(ff) the unlawful possession of firearms, to wit:
(gg) the unlawful possession of ammunition, to wit:
(aa) terrorism in contravention of Section 54 (1) of Act 74 of 1982,
read with Sections 1, 54 (6), 54 (7) and 69 of the said Act, to wit,
placing an explosive device, consisting of 2 (two) 158 Mini-Limpet mines
and 4 (four) SZ-3 demolition charges, at an electricity transformer
in front of the South African Police ("SAP") Radio technical workshop
and causing the device to detonate, causing damage to the said transformer

(dd) the unlawful possession of hand-grenades and bombs, to wit:
(ee) the unlawful possession of machine guns or machine rifles and/or parts thereof, to wit:
(ff) the unlawful possession of firearms, to wit:
(gg) the unlawful possession of ammunition without being in lawful possession of an arm or arms capable of firing such ammunition, to wit:
(hh) all offences, delicts, acts or omissions arising out of the activities of Riaz Saloojee and Aboobaker Ismail as Regional Director of Ordinance, and Chief of Ordinance respectively, which were carried out with weapons and explosives which were brought into the country by one or more of the following operatives acting under their command: Felicity Barbara Anderson, John Sporoplos, Nigel Crawhall, James Garraway, Martha Gordon, Evan Abrahamse, Dominic Pelissimo, Klaus and Rene Von Twillert, Doug McKinley, Hazel Compton, Lee Hobbs, Jack Nolte, Bob Jolise and Pierre Thierry, committed in or near Zimbabwe during or about the periods 1988 to 1990 and 1987 to 1994;
(aa) terrorism in contravention of Section 54 (1) of Act 74 of 1982,
read with Sections 1, 54 (6), 54 (7) and 69 of the said Act, to wit,
placing an explosive device., consisting of 2 (two) 158 Mini-Limpet
mines and 4 (four) SZ-3 demolition charges, at an electricity transformer
in front of the South African Police ("SAP") Radio technical workshop
and causing the device to detonate, causing damage to the said transformer
and adjacent State and private properties, committed at or near Ridge
Road, Durban, on or about 28 January 1989;
(bb) terrorism in contravention of Section 54 (1) of Act 74 of 1982
read with Sections 1, 54 (6), 54 (7) and 69 of the said Act, to wit,
placing an explosive device consisting of 2 (two) 158 Mini-Limpet mines
an 4 (four) SZ-3 demolition charges and causing the device to detonate,
causing damage to the adjacent State and private properties, committed
at or nearthe Natal Command Headquaters of the South African Defence
Force ("SADF'), Marine Parade, Durban, on or about 10 March 1989 ;
(cc) the explosion, committed at or near the SAP Single Quarters, C.R.
Swart Square, Stanger Street, Durban, on or about 7 April 1989;
(dd) the unlawful possession of hand-grenades and bombs, to wit:
(ee) the unlawful possession of machine guns or machine rifles and/or parts thereof, to wit:
(ff) the unlawful possession of firearms without being licensed to possess them, to wit:
(gg) the unlawful possession of ammunition without being in lawful possession of an arm or arms capable of firing such ammunition, to wit:
(hh) all offences, delicts, acts or omissions arising out of the activities of Riaz Saloojee and Aboobaker Ismail as Regional Director of Ordinance, and Chief of Ordinance respectively, which were carried out with weapons and explosives which were brought into the country by one or more of the following operatives acting under their command: Felicity Barbara Anderson, John Sporoplos, Nigel Crawhall, James Garraway, Martha Gordon, Evan Abrahamse, Dominic Pelissimo, Klaus and Rene Von Twillert, Doug McKinley, Hazel Compton, Lee Hobbs, Jackie Nolte, Bob Jolise and Pierre Thierry, committed during or about the periods 1988 to 1990 and 1987 to 1994;
(aa) the murder of BENJAMIN LANGA;
(bb) the unlawful possession of firearms; and
(cc) the unlawful possession of ammunition, committed at or near Pietermaritzburg
on or about 20 May 1984;
(dd) the attempted murder of ZIZWE ABEDNIGO MTHETHWA;
(ee) the unlawful possession of firearms;
(ff) the unlawful possession of ammunition; and
(gg) malicious injury to state property, committed on or about 21 May
1988;
(aa) the attack on a police vehicle, committed at or near Duduza Stadium
on or about 11 June 1989 ;
(bb) the attack at the Duduza Administration Offices; and
(cc) the attack at the Kwa-Thema Police Station, committed on or about
22 June 1989;
(dd) the attack at the Dunnottar Post Office, committed during or about
October 1988;
(ee) the attack at the Brakpan Home Affairs offices, committed during
or about December 1988;
(ff) the attack at the Tsakane Police Barracks, committed during or
about 1988;
(gg) the attack at the Kwa-ThemaAdministration Offices, committed on
or about 20 October 1988; and
(hh) the attack at the Nigel Post Office, committed on or about 14 April
1989; and
(aa) the smuggling of firearms and hand-grenades into South Africa,
committed at or near Umlazi and Claremont in the vicinity of Greater
Durban during or about 1988 to 1990;
(bb) the throwing of an F1 defensive grenade through a window of a house
in an attempt to kill one NKANYISO MALINGA and two other members of
the KwaZulu Police, committed in or near a house in Z Section Umlazi
on or about 11 June 1990;
(cc) the ordering of two explosions, committed at or near two branches
of CNA, at or near 320 West Street, Durban and 14 Pine City, Hill Street,
Pinetown, on or about 7 October 1988; and
(dd) the injury of MIKE BLAKE, committed at or near 14 Pine City, Hill
Street, Pinetown.
