PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted -

  1. on 2 May 2001 to -
    1. JACOBUS CHRISTOFFEL KENNARD ERASMUS (identity number 6010145090083), in respect of all acts and offences directly associated with the transportation and detonation of a bomb, committed at the Community Centre in Salt River, Cape Town, during or about 1987/88;
    2. VUSUMUZI NICHOLAS ZULU (identity number 5105215607088), in respect of high treason, committed during or about 1979;
    3. JOSEPH ALPHONSE JACQUESSON (date of birth 20 May 1943), in respect of -
      1. all offences and delicts resulting from harbouring Moosa "Mosie" Moolla subsequent to the latter's escape from police custody, committed during or about 1964 at or near Krugersdorp; and
      2. all offences and delicts resulting from the export to the United Kingdom of capital in contravention of the South African exchange control laws, committed during or about the period 1982 to 1987, including the offences for which he was convicted, in the then Durban Supreme Court, under case no.       2. the fetching, in contravention of section 54(1) (ii) and (iii) of the said Act, by him of three military trained members of the ANC, including MBONGWA, from Ingwavuma and bringing them to the Durban area for the purpose of training other persons for the ANC in the use of arms and explosives to enable such persons to commit acts of violence in support of the aims of the ANC to overthrow the State authority in the Republic;
      3. the supplying, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been used to cause an explosion at OK Bazaars, West Street, Durban, committed on or about 27 September 1985;
      4. the supplying, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been used to cause an explosion at Game Discount World, West Street, Durban, committed on or about 27 September 1985;
      5. the furnishing, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been planted at Spar Foodliner, Trust Bank Arcade, Durban, committed on or about 27 September 1985;
      6. the supplying, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been used in causing an explosion at Checkers, Smith Street, Durban, committed on or about 27 September 1985;
      7. the furnishing, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been used to cause the explosion which occurred at the Executive Hotel, Umlazi, committed on or about 28 September 1985; and
      8. the supplying, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of other persons with explosives and explosive devices which could have been used to cause the explosion that killed ZINTO CELE and MANDLENKOSI NDIMANDE and injured SIBUSISO MAZIBUKO at Grosvenor Girls' School, committed on or about 24 October 1985;
    12. SIBUSISO MBONGWA (identity number 5210275707081), in respect of -
      1. unlawfully entering the RSA and proceeding to the Alan Taylor Residence, Durban, with the intention of meeting those in charge of MK there and giving members of the ANC political and military training to enable them to commit acts of violence in support of the aim to overthrow the State authority in the Republic by force in contravention of section 54(1) (ii) and (iii) of the Terrorism Act. No. 74 of 1982;
      2. the training, in contravention of section 54(1)(ii) and (iii) of the said Act, by him of Vusimuzi Wesley Mahlobo and another person on political matters and explaining to them about booby traps and speaking to them about reconnaissance and surveillance;
    13. ORDWAY Q MSOMI (identity number 6509235269085), in respect of -
      1. the establishment, in contravention of section 54(1)(ii) and (iii) of the Terrorism Act, No. 74 of 1982, of a DLB consisting of arms, ammunition, explosives and explosive devices, and the removal of the undermentioned items from it and the transportation thereof to Umgababa:
        1. two VZ 25 submachine guns (She Petersen);
        2. one remote control device;
        3. one block of TNT;
        4. one silencer for an AK47 machine rifle;
        5. one electronic detonator;
        6. three electronic timing devices;
        7. one TM57 landmine and detonator; and
        8. two books on explosives
      2. the receiving, in contravention of section 54(1)(ii) and (iii) of the said Act, of training from one Stan in the use of firearms, explosives and explosive devices;
      3. the establishment, in contravention of section 54(1)(ii) and (iii) of the said Act, of, or the rendering of assistance in the establishment of, a DLB at or near Umgababa which contained a cache of arms consisting of the following:
        1. one VZ 25 submachine gun; three loaded magazines for the above;
        2. one belt;
        3. two lengths of detonating fuse;
        4. one 200g detonating fuse;
        5. one 200g block of TNT;
        6. one TM 57 landmine;
        7. three detonators for TM 57 landmine;
        8. one remote control charge;
        9. one time switch; and
        10. 22 electrical detonators;
      4. instructing, in contravention of section 54(1)(ii) and (iii) of the said Act, the detonation of a limpet mine at OK Bazaars, West Street, Durban, committed on or about 27 September 1985;
      5. instructing, in contravention of section 54(1)(ii) and (iii) of the said Act, the detonation of a limpet mine at Game Discount World, Durban, committed on or about 27 September 1985;
      6. detonating, in contravention of section 54(1)(ii) and (iii) of the said Act, a limpet mine at the Mobeni Post Office, committed on or about 8 December 1985; and
      7. detonating, in contravention of section 54(1)(ii) and (iii) of the said Act, an explosive device near a VW Kombi, committed on or about 21 December 1985 at or near the corner of Pine and Alberts Streets, Durban;
    14. JOHN LOUIS MCPHERSON (identity number 4806095096083), in respect of all delicts and offences arising from his participation in a plan to bomb the meeting of the NEC of the ANC held at Solomon Mahlangu Freedom College, Morogoro, Tanzania;
    15. MOHAPI LAZARUS SELAMOLELA (identity number 5612305816081), in respect of all offences arising from his failure to report the relevant information within his knowledge concerning the killing of Dr and Mrs Ribeiro at Pretoria, committed during 1986;

      6. the submission of false and/or fraudulent claims to the Government's secret fund in order to obtain funds for convert operations, committed during or about the period 1985 to the end of 1990;

      (cc) malicious injury to property by damaging a goods train with petrol bombs, committed during or about August 1962;
      (dd) the theft of dynamite from a road construction company, committed at or near Mariannhill during or about the period 1961 to 1963;
      (ee) malicious injury to property by destroying electric pylons, committed at or near Pinetown during or about the period 1961 to 1963;

      (ii) recruiting and giving military training to ANC cadres, committed during or about the period 1961 to 1963;

    2. as a member of the MK Command, London:

      (aa) the infiltration of trained MK cadres into South Africa, committed during or about the period 1965 to 1976; and
      (bb) the detonation of leaflet bombs in various city centres inside South Africa, committed during or about the period 1965 to 1976;

    3. as part of the senior MK Command and ANC leadership:

    (aa) conspiring with, and aiding and abetting MK cadres to prosecute an armed struggle against the then South African government, committed during or about the period 1977 to 1989; and
    (bb) malicious injury to property and all other offences directly resulting from an explosion at Anthea's Club, situated at the Holiday Inn, Pietersburg, committed during or about the period 1977 to 1989; and

    1. as part of senior ANC leadership-:

    6. (aa) the infiltratration of weapons and trained MK cadres into South Africa as part of Operation Vula, which was aimed at strengthening the ANC underground structures inside South Africa, committed during or about the period 1990 to 1994; and
    (bb) the unlawful establishment of Self-Defence Units in various parts of South Africa and supply of arms to these units, committed during or about the period 1990 to 1994;
