TRUTH AND RECONCILIATION COMMISSION: COMMITTEE ON AMNESTY

PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted -

  1. on 23 January 2001 to -
  1. SANDI GARDNER SIJAKE (identity number 4510055498087), in respect of terrorism committed during 1972;
  2. ACE EZEKIEL MOTAUNG (date of birth 16 June 1968), in respect of the offences of arson and terrorism for which he was sentenced, in the Potchefstroom Magistrate's Court, on or about 10 December 1987, to direct imprisonment;
  3. BOITUMELO JOSEPH LEEPILOE (identity number 5810285900087), in respect of the offence of terrorism, committed at or near Johannesburg during or about 1985;
  4. DEAN ANTHONY BUCHANNAN STUART (identity number 6004265140000), in respect of offences or delicts flowing from his activities as an agent of the ANC and MK during his tenure as a permanent force member of the SADF, during or about the period January 1982 to October 1988;
  5. KGALAPA ELIAS MOGASHOA (identity number 6604035440083), in respect of terrorism as defined in the then Terrorism Act of 1967, relating to -(aa) the recruiting and training of ANC cadres; (bb) the transporting (infiltrating) of weapons from Botswana to South Africa; (cc) the illegal possession of arms and ammunition (weapons and explosives); and (dd) four counts of attempted murder;
  6. MOSES RAE BEEFTY MABOITSHEGO (identity number 5010275685083), in respect of the unlawful possession and distribution of firearms and other weapons, committed during the period 1985 to 1990;
  7. PHANGASA MOHLABA (identity number 6806055892081), in respect of harbouring MK cadres and providing transport to MK cadres in the Tzaneen area, committed during the period 1989 to 1990;
  8. ROGER EMIL ALLINGHAM (identity number 4508305459081), in respect of -
  1. the gathering of intelligence and passing of information to MK; and (bb) the unlawful possession, transportation and handling of weapons of war;
  1. SIPHO JULIUS MAZIBUKO (date of birth August 1976), in respect of the unlawful possession of an AK47 rifle and ammunition, committed at or near Thokoza on or about 20 April 1994;
  2. LENNOX MPUTHUMI COSA (date of birth 9 August 1963), in respect of the unlawful possession of a 9mm pistol and ammunition, committed at or near Rivonia on or about 18 April 1994;
  1. on 24 January 2001 to -
    1. ALEXANDER ERWIN (identity number 4801175119004), in respect of -
      1. all offences and delicts arising from his participation in a defence structure for union leaders; and (bb) the unlawful possession of arms and ammunition, committed in KwaZulu-Natal during or about the period 1988 to 1994;
    2. SYDNEY NDABA (identity number 4811205519081), in respect of -
      1. the unlawful possession of an AK47 rifle with 16 rounds of ammunition; and
      2. the unlawful possession of a revolver with four rounds of ammunition, committed at or near 82 Siluma View, Katlehong, on or about 13 January 1991;
    3. HELENE PASTOORS (date of birth 9 August 1942), in respect of the unlawful delivery of a motor vehicle containing explosive material, which she drove from Swaziland to Pretoria on or about 19 May 1983;
    4. GIFT SIPHO SIBANDA (Identity number 6201215852086), in respect of the unlawful possession and supply of firearms, explosives and other weapons of war, committed during the period 1978 to 1989;
  2. on 29 January 2001 to -
    1. SELLO DAVID THEJANE (identity number 7007260535081), in respect of -
      1. the torture of ABEL CHOANE,
      2. the torture of NORMAN CHOANE; and
      3. the torture of MOEKETSI JOHANNES JIKILE, committed in or near Bloemfontein during or about 1991 and 1992;
