PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1 995), was granted

  1. on 28 January 1999 to NICHOLAS MABUYA (identity number 690705585085), in respect of the offence of being in illegal possession of a hand grenade committed on or about 10 January 1992 in the district of Vosloorus;

  2. on 28 January 1999 to WILLEM HENDRICK WILLEMSE (identity number 3809145071081), in respect of all offences associated with a political objective as defined by the Act, and which fall within the ambit of the Act, committed or authorised by him during 1986 as a member of the South African Department of Correctional Services in connection with the aiding and abetting of the escape of Charles Sebe from Middledrift Prison;

  3. on 28 January 1999 to AARON MASUKU (identity number 6305066075083), in respect of the illegal possession of 6 AK 47 guns and ammunition committed on or about 27 January 1991 at or near Vosloorus Hostel in the district of Vosloorus;

  4. on 1 February 1999 to SILIMELA NGESI (QUKUMBANA) (identity number 68061 45858000), in respect of -

  1. the attack on the East London Petrol Depot;
  2. the attempted murder of SGT OOSTHUIZEN and another unknown policemen;
  3. malicious damage to property in respect of motor vehicles and weapons; and
  4. unlawful possession of firearms, to wit, a R4 rifle, R5 rifle, an AK 47 rifle and 2 RPG 7 rocket launchers,

committed in or about August 1993 at or near the district of East London;

  3. the unlawful possession of firearms, ammunition and hand grenades, committed on or about 22 March 1993 and 13 July 1993 at or near Vanderbijlpark and Heilbron respectively;

  13. the explosion of an explosive device, committed on or about 19 January 1994 at an electricity pylon between Potchefstroom and Orkney in the district of Stilfontein;
  14. the explosion of explosive devices, committed on or about 21 January 1994 on two railway lines between Hennenman and Kroonstad in the district of Kroonstad;
  15. the explosion of an explosive device, committed on or about 26 January 1994 on a railway line between Orkney and Leeudoringstad in the district of Orkney;
  16. the explosion of an explosive device, committed on or about 28 January 1994 on a railway line between Orkney and Leeudoringstad in the district of Leeudoringstad;
  17. the explosion of an explosive device, committed on or about 31 January 1994 on a railway line between Orkney and Leeudoringstad in the district of Orkney;
  18. the explosion of an explosive device, committed on or about 1 February 1994 on a railway line between Jordaan and Kroonstad in the district of Kroonstad;
  19. the explosion of an explosive device, committed on or about 31 January 1994 at an electricity pylon in the district of Vierfontein;
  20. the explosion of an explosive device, committed on or about 4 February 1994 on a railway line between Orkney and Leeudoringstad in the district of Leeudoringstad;
  21. the explosion of an explosive device, committed during or about the period 31 January or 7 February 1994 on a railway line between Leeudoringstad and Makwassie in the district of Leeudoringstad; and
  22. the unlawful possession of 4,25kg of explosive material and one electric detonator, committed during or about the period 31 January 1994 and 3 February 1994 at or near Vierfontein;
  1. In addition to the above, ANDRIES STEFANUS KRIEL; JAN CORNELIUS LABUSCHAGNE and DANIEL WILHELM VAN DER WATT are granted amnesty in respect of all offences and claims that may arise out of-
  1. the explosion of an explosive device at an electric power pole between Bothaville and Viljoenskroon, committed on or about 5 February 1994 in the district of Bothaville;
  2. the unlawful possession of two home-made shotguns, committed on or about 7 February 1994 at or near Bothaville; and
  3. the unlawful possession of five electric detonators, sixty four powergel detonators and 18,07 kg of explosive material, committed on or about 7 February 1994 at or near Bothaville;
  1. on 4 February 1999 to MASOKA MASUKU in respect of the illegal possession of an unlicensed firearm, committed on or about 28 March 1994 in Rosebank, Johannesburg;

  2. on 4 February 1999 to ANDRIES MANDLA NZIMA (identity number 6802205482089), in respect of the illegal possession of an unlicensed firearm, committed on or about 20 September 1993 at or near Vosloorus;

  7. the unlawful failure to report the existence of arms, ammunition and explosives to the police whilst they were in the knowledge that certain persons were in unlawful possession of such arms, ammunition and explosives in contravention of section 35(a) the Arms and Ammunition Act,1969 (Act No. 75 of 1969), committed during the period December 1990 to April 1994; and
  8. any crime of conspiracy where the subject matter of the conspiracy relates to any of the offences referred to in paragraphs (aa) to (gg) above;
  1. JEFFREY THAMSANQA RADEBE in respect of his conviction under the Internal Security Act, 1982 (Act No. 74 of 1982), for terrorism, being a member of a banned organisation and for undergoing military training; and
  2. SIPHO JOEL DANIEL SITHOLE in respect of-
  1. the unlawful pointing and discharging of a firearm, commuted during September 1984 at or near Ngwelezane;
  2. the unlawful possession of a firearm, committed during September 1984 at or near Ngwelesane; and the unlawful importation of/conspiracy to import, rocket launchers, explosive projectiles and other arms, weapons and ammunition, committed on or about 1 February 1993 through the Golela border post;
  1. on 16 February 1999 to WANDA BONGANI MDLETSHE (date of birth 8 February 1973), in respect of the murder of KHECHLA NTSHINGILA, committed on or about 29 March 1993 at or near Driefontein;

  2. on 16 February 1999 to -
