PROCLAMATION
by the President of the Republic of South Africa
DETERMINATION OF THE UPPER LIMIT OF THE SALARIES AND ALLOWANCES OF PREMIERS, MEMBERS OF EXECUTIVE COUNCILS AND MEMBERS OF PROVINCIAL LEGISLATURES
In terms of section 6 (1) of the Remuneration of Public Office Bearers Act, 1998 (Act No. 20 of 1998) (the "Remuneration Act"), I hereby determine that the upper limit of the annual salaries and allowances of the various grades of office-bearers specified in Column 1 of the Schedule shall be as set out in Column 2 of the Schedule with effect from 1 April 1999, subject of section 6 (7) (a) and (b) of the Remuneration Act.
In terms of section 6 (4) of the Remuneration Act, I determine the amount of R40 000 per annum as that portion of the remuneration of an office bearer specified in Column 1 of the Schedule to which section 8 (1) (d) of the Income Tax Act, 1962 (Act No. 58 of 1962), shall apply.
In terms of section 6 (1) of the Remuneration Act, I hereby determine that an amount equal to one twelfth of the relevant total remuneration payable to an office bearer in terms of Proclamation No. 115 of 1998 shall be the upper limit of a once off special allowance payable to a person who, on 1 June 1999, was a Premier, a member of an Executive Council or a member of a provincial legislature, as the case may be, and who was not designated as a representative by the Electoral Commission in terms of item 16 of Schedule 2 to the Constitution of the Republic of South Africa, 1993, pursuant to the election on 2 June 1999: Provided that no such special allowance is payable to a person who, within one month of 1 June 1999, was elected or appointed to any office under the State and received or is to receive remuneration for serving in that office: Provided further that any such special allowance shall be regarded as having been due to the persons concerned on 1 June 1999.
In this Proclamation, unless the context indicates otherwise, any word or expression to which a meaning has been assigned in the Remuneration Act, the Constitution of the Republic of South Africa, 1996, or the relevant Rules and Orders in terms of section 116 of the Constitution, bears that meaning.
Proclamation No. 115 of 1998, published in the Government Gazette of 13 November 1998, is hereby repealed.
