PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted

  1. on 11 November 1998 to MAURICE ABRAHAM MTHOMBENI (date of birth 6 May 1942), in respect of -
  1. leaving the Republic of South Africa during April 1965 for the purpose of proceeding to another country without being in possession of a valid passport-or a permit referred to in section 2(a) of the Departure from the Union Regulation Act, 1955 (Act No. 34 of 1955);
  2. leaving the Republic of South Africa without authority during April 1965 at a place other than a port referred to in section 2(b) of the Departure from the Union Regulation Act, 1955 (Act No. 34 of 1955); and
  3. undergoing military training in contravention of the provisions of the Terrorism Act, 1967 (Act No. 83 of 1967) during April 1965;

  1. on 11 November 1998 to JOHAN MICHAEL PRINSLOO (identity number 3704185010083),in respect of the illegal trading in, possession of and/or the firing of ±800 R1 rifle bullets in or at Tiegerspoort during the period March / April 1994;

  3. the unlawful possession of explosives namely 7 x MPM limpet mines, 9 x VZD3M detonators and 9 x "Springdoppies" for the VZD3 detonators,

committed on or about 27 September 1991 at or near Krugersdorp, Gauteng;

  1. attempted murder of

  2. unlawful possession of arms and ammunition,

committed on or about 17 November 1993 at or near Queenstown, Eastern Cape;

  1. on 17 November 1998 to MDUDUZI REMEMBER NDLOVU (identity number 7105115470084), in respect of
  1. murder of SIBUSISO GUMEDE; and
  2. robbery with aggravating circumstances of one HMC sub-machine gun,

and any delict which may flow therefrom, committed on or about 16 April 1991 at or near Kwa-Mashu, Durban;

  1. on 18 November 1998 to MZWAKHE PHILEMON MNDEBELE (identity number 6801315575 089), in respect of being in unlawful possession of a firearm on or about 28 November 1992 at or near Ratanda Township, Heidelberg, Gauteng;

  2. on 18 November 1998 to PIETER STEPHANUS ALBERTUS NEL (identity number 5604285035089), in respect of -

  1. theft of explosives on or about 28 December 1991, and
  2. unlawful possession of explosives and a home-made bomb, on or about 16 January 1992

at or near Nelspruit;

  1. on 18 November 1998 to JOHN HAROLD JEFFERY (identity number 6310315163002), in respect of malicious damage to property by spraying political slogans on a bus terminal wall, committed on or about 29 December 1985 at or near George;

  2. on 19 November 1998 to MAKANDA AARON NDWALANE (identity number 4409095467089), in respect of being in unlawful possession of firearms and ammunition in contravention of sections 2 and 3 read with sections 1, 39 and 40 of the Arms and Ammunition Act No. 75 of 1969, committed during the period 4 - 7 July 1992 at or near Betanya, in the district of Port Shepstone;

  3. on 19 November 1998 to JOSIAS SUNNYBOY MOGASHOA (identity number 6505265351082), in respect of -

  1. planting of plastic explosives committed on or about 16/17 October 1993 at or near Kwaggarand Motors, 144 Middle Crescent, Pretoria;
  2. planting of T & T explosives committed on or about 31 October/1 November 1993 at or near P.A. Swart Motors at 13th Avenue Menlopark; and
  3. illegal possession of a 9mm pistol, hand grenades, landmine parts and detonators committed on or about 6 December 1993;

  1. on 19 November 1998 to EDUARD PIETER ROUX (identity number 6203295021004), in respect of -

  1. contravention of sections 21 (1) and 27(1) (c) read with sections 2(2) and (3) of the Explosives Act No. 26 of 1956, in that the applicant caused damage to the offices of the Independent Electoral Commission, committed on or about 21 April 1994 at or near Hoopstad; and
  2. contravention of sections 4(1), 3(1) and 5(2) of the Explosives Act No. 26 of 1956, namely the unlawful possession of explosives, committed during April 1994 in the district of Hoopstad;
  1. on 4 December 1998 to-
  1. KWENZAKWAKHE NICHOLAS MSANI (identity number 690435907085);
  2. PHELELANI BHEKIZENZO V. HLONGWA (identity number 7210065682088); and

    (aa) murder of JAN BAMBO committed on or about 5 December 1992 at or near Khayelitsha Railway Station;
    (bb) attempted murder of MALCOM VISSER, LIZETTE THEUNISSEN, DENNIS SMITH, JASON COLLIE, ALLEN WILLIAMS and AMANDA WARNER committed on or about 26 December 1992 at Claremont Restaurant;
    (cc) attempted murder of COSMOS BHEKUMZI, JACKSON MJAYIYA, SANDISILE NTSHICA, SHILANU MTAMZELI and JERRY NKOBEZEKWA committed on or about 5 December 1992 at or near Khayelitsha Railway Station,

  2. FALIBANGO WALTER THANDA (date of birth 29 December 1960), in respect of -

    (aa) killing of JAN BAMBO committed on or about 5 December 1992 at or near Khayelitsha Railway Station;
    (bb) attempted murder of COSMOS BHEKUMZI, JACKSON MJAYIYA, SANDISILE NTSHICA, SHILANU MTAMZELI and JERRY NKOBEZEKWA committed on or about 5 December 1992 at or near Khayelitsha Railway Station;
    (cc) murder of PETER DYANI and PATRICK TUTU on or about 8 September 1992 at or near Crossroads;
    (dd) murder of Constable MKHWANAZ and attempted murder of Sergeant JOHANNES MEYER committed on or about 12 January 1993 at or near NY 108 Gugulethu; and

  3. GCINIKHAYA MAKOMA (date of birth 20 January 1976), in respect of his involvement in the attack on the police vehicle on Zola Budd Road and for unlawful possession of a firearm, committed on or about 5 December 1992 at or near Khayelitsha in the district of Cape Town;

  1. on 8 December 1998 to THABELO PATRICK MASEKO (identity number 5604035922081), in respect of -
  1. the murder of FRANCISCO DE SOUSA;
  2. attempted murder of JOAO JARDIM; and
  3. armed robbery with aggravating circumstances,

committed on or about 16 November 1990 at or near Westonaria:

  1. on 8 December 1998 to THULASIZWE PHILEMON M. CELE (identity number 7107295472084), in respect of the murder of SHADRACK LINDELA ZULU committed on or about 15 July 1993 at or near Nokweja Location in the district of Ixopo;

  2. on 8 December 1998 to SONKALANI MOSES MABENA (identity number 6312203299083), in respect of -

  1. attempted murder of JAN VAN ZYL; and
  2. illegal possession of firearm and ammunition,

committed on or about 3 November 1992 at or near the corner of Klatitshane and Kgashwana Street in the district of Kwa-Thema;

  1. on 10 December 1998 to NTSIKELELO A. JACKSON ZWAYI (identity number 640208527181), in respect of -
  1. murder of SOLOMON AMOS NDLANGA-MANDLA;
  2. illegal possession of a firearm and ammunition,

committed on or about 18 January 1994 at or near Swartkopies Road in the district of Alberton;

  1. on 10 December 1998 to PHILANE ZONDI (identity number 7306245667088), in respect of -
  1. murder of SIHLE MAKHAPHENI MPANZA committed on or about 22 March 1994 in the district of Empangeni; and
  2. for illegally crossing the borders of South Africa when he went for and resumed from military training committed during 1990;
  1. on 14 December 1998 to
  1. PIETER MAGIEL BREYTENBACH (identity number 5710315089085); and
  2. DE WET JOHANN STRYDOM (identity number 6403295092084),

in respect of -

(aa) murder of KLEINBOOI RAMOLLA committed on or about 28 February 1994 at or near Bultfontein;
(bb) sabotage, unlawful possession of explosives, explosive devices, unlicensed weapons, ammunition and theft, committed between February and April 1994;

  1. on 14 December 1998 to GIDEON JOHANNES NIEWOUDT (identity number 5102045016002), in respect of the assault of Mr Peter Jones committed during September 1977 at or near Port Elizabeth;

  2. on 14 December 1998 to MDUDUZI CYRIL NGEMA (date of birth 25 April 1964), in respect of -

  1. murder of JOHN KHANYILE committed on or about 29 September 1992 in the district of Umlazi;
  2. robbed with aggravating circumstances committed on or about 29 September 1992 in the district of Umlazi; and
  3. murder of CHRISTOPHER NHLANHLA MYEZA committed on or about 1 October 1992 at or near Westville University

  1. on 15 December 1998 to BOY VUSIMUZI GWAMANDA ( identity number 1/6789469/6), in respect of:-

  1. his involvement in the conspiracy to kill MATTHEWS PHOSA during 1990 at Barberton and Nelspruit;
  2. his involvement in the assault upon ENOCH CELE on or about 27 November 1993 in the Ndwedwe district;
  3. his shooting at a group of boys on or about 27 November 1993 in the Montobela area;
  4. his shooting at a group of boys/young men on or about 27 November 1993 at or near the Monalisa area;
  5. the attempted murder of Mr GUMEDE and the robbery of Mr GUMEDE's motor vehicle on or about 29 November 1993 in the Sokombo area;
  6. the murder of an unknown man committed during the period 30 November 1993 to 2 December 1993 in the Sokombo area; and
  7. the unlawful possession of firearms and ammunition in relation to the incidents referred to in (i) to (vi) above;

  1. on 15 December 1998 to MANGALISEKILE BHANI (date of birth 1 January 1970), in respect of -

  1. murder of JOAO MANUEL JARDIM; and
  2. armed robbery,

committed on or about 16 April 1994 at or near 14 Station Road in the district of Randfontein;

  1. on 15 December 1998 to PELELE LAWRENCE SHONGWE (identity number 7111145550081), in respect of -

  1. murder of BONGANI MALINGA;
  2. illegal possession of a firearm and ammunition; and
  3. theft of a firearm and ammunition. committed on or about 22 October 1993 in the district of Ermelo.
  1. on 15 December 1998 to -

  1. JOHN FANYANA MNDEBELE (identity number 5203175712087), in respect of -

(aa) the murder of JWI ZWANE, CHRIS NGWENYA and LIMDIWE NKOSI; and
(bb) the attempted murder of THEMBISILE ELDAH NKAMBULE, HAPPY MHLONGO, SIBUSISO TITO NKOSI and ERIC NKOSI;

  1. SIPHO SILAS NKONYANA (identity number 6501135447085), in respect of -

(aa) the murder of JWI ZWANE, CHRIS NGWENYA and LINDIWE NKOSI;
(bb) the attempted murder of THEMBISILE ELDAH NKAMBULE, HAPPY MHLONGO, SIBUSISO TITO NKOSI and ERIC NKOSI; and

the illegal possession of a firearm and ammunition.,

  1. NICHOLAS MFUNDISI ZWANE (identity number 5801055995084), in respect of -

(aa) the murder of JWI ZWANE, CHRIS NGWENYA and LINDIWE NKOSI; and
(bb) the attempted murder of THEMBISILE ELDAH NKAMBULE, HAPPY MHLONGO, SIBUSISO TITO NKOSI and ERIC NKOSI;

  1. JABU AARON MKHWANAZI (identity number 6710095705081), in respect of -

(aa) the murder of JWI ZWANE, CHRIS NGWENYA and LINDIWE NKOSI;
(bb) the attempted murder of THEMBISILE ELDAH NKAMBULE, HAPPY MHLONGO, SIBUSISO TITO NKOSI and ERIC NKOSI; and
(cc) the illegal possession of an AK 47 rifle, a Makarov pistol and ammunition;

  1. MPUMELELO LIVINGSTONE LUKHELE (identity number 7208215424088), in respect of -

(aa) the murder of OBED FRIDAY NHLABATHI and BHE MALINGA;
(bb) the attempted murder on an unknown number of members of the South African Police (SAP);and
(cc) illegal possession of firearms and ammunition;

  1. MANDLENKOSI ENOCH "GUITAR" MNISI (identity number 6312035493082), in respect of -

(aa) illegal possession of two (2) hand grenades;
(bb) attempted murder on an unknown number of members of the South African Police (SAP); and
(cc) damage to a police vehicle by throwing a hand grenade in the direction of the police and members of the public;

  1. MZWANDILE HOLLINGWOOD GUSHU (date of birth 18 January 1964), in respect of -

(aa) the murder of JWI ZWANE, CHRIS NGWENYA, LINDIWE NKOSI, DAVID DE BRUIN, ADVICE GWALA and THEMBA MLANGENI; and

(bb) the attempted murder of HAPPY MHLONGO, ERIC NKOSI, SIBUSISO NKOSI, THEMBISILE ELDAH NKAMBULE, WYNAND FOURIE, CHRISTOPHER MASINDA, REMICARD MYENI and ALPHEUS ALI MSIBI;

  1. PAULOS PISTOL NKONYANE (identity number 6102195274087), in respect of -

(aa) the murder of CHRIS NGWENYA and LINDIWE NKOSI; and
(bb) the attempted murder of THEMBISILE ELDAH NKAMBULE;

  1. LUCKY PETROS MBOKANE (identity number 6909065484087), in respect of -

(aa) the murder of DAVID DE BRUIN; and
(bb) the attempted murder of WYNAND FOURIE, CHRISTOPHER MASINA and REMICARD MYENI;

  1. BONGANI SIBUSISO WILBERFORCE KHABA (date of birth 27 January 1974), in respect of the murder of OBED FRIDAY NHLABATHI; and
