TRUTH AND RECONCILIATION COMMISSION: COMMITTEE ON AMNESTY

PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted

(a) on 21 August 1998 to -

  1. MOSIUWA ISAIAH KHOTLE (identity number 691004 5949 082); and
  2. LERATO ABEL KHOTLE (date of birth 14 December 1974),

in respect of the robbery of Pep Stores committed on 17 February 1992 at or near Botshabelo;

(b) on 11 September 1998 to ROBIN HOUSTON HOLMES (identity number 460503 5133 00 0), in respect of the offence of illegal production and distribution of prohibited material, namely T-shirts depicting defiance of the Government committed during or about the period 1977 to 1978 at or near Pietermaritzburg;

(c) on 7 September 1998 to MATTHEW SIDNEY GAYLARD (identity number 690818 5094 08 1), in respect of -

  1. trespassing; and
  2. illegal picketing,

committed during the period 1989 to 1990 at or near Stellenbosch; and

(d) on 7 September 1998 to

  1. JOSEPH ELIAS MAKHURA (identity number 590923 5796 08 0);
  2. FRANS TING TING MASANGO (identity number 580814 5894 08 6);
  3. OBED MASINA (date of birth 26 December 1950),

in respect of the murder of Brigadier ANDREW MALOPE committed in or during August 1986 at or near Winterveld in the former Republic of Bophuthatswana; and

(iv) NEO POTSANE (identity number 600302 5922 08 7),
for his participation in the conspiracy to murder Brigadier ANDREW MALOPE in or during August 1986 at or near Winterveld in the former Republic of Bophuthatswana;

(e) on 16 September 1998 to PHILA MARTIN DOLO (date of birth 21 November 1968),

in respect of

  1. the murder of JACOB HLOMELA MABASO;
  2. the attempted murder of EDWARD NELUSHI;
  3. the attempted murder of IAN ALEXANDER VELDMAN;
  4. contravention of section 32(1)(a), read with sections 1, 39(2)(aA) and 40 of Act No.75 of 1969, namely the unlawful possession of machine guns;
  5. contravention of section 32(1)(e), read with sections 1,39(2)(aA) and 40 of Act No. 75 of 1969, namely the unlawful possession of ammunition intended to be fired from a machine gun or machine rifle or any simile armament;
  6. contravention of section 32(1)(c), read with sections 1, 39(2)(aA) and 40 of Act No. 75 of 1969, namely the unlawful possession of any explosive or incendiary device or any part thereof;
  7. contravention of section 32(1)(b),read with sections 2, 39(2)(aA) and 40 of Act No. 75 of 1969, namely the unlawful possession of a grenade,

on or about 30 May 1993 at or near Diepkloof in the then Transvaal; and

  1. all acts in relation to the planning, ordering and preparation of the failed bombing of the Yeoville Police Station on 29 May 1993, including the unlawful possession of explosives in contravention of section 28(1), read with sections 1, 27(1)(c) and 28(2? of Act 26 of 1956;

(f) on 16 September 1998 to SHAKESPEARE THAMI BUTHELEZI (date of birth 12 December 1969), in respect of

  1. the murder of FREDDY MASHAMAITE;
  2. robbery of FREDDY MASHAMAITE;
  3. unlawful possession of firearm and ammunition; committed on or about 21 January 1993 at or near Monaheng Section, Katlehong; and
  4. the attempted murder of

RICHARD MALOPE;

BASE TLADI; and

KHEHLA MOSES TSHABALALA,

committed on or about 16 March 1993 at or near Twala Section, Kathlehong;

(g) on 18 September 1998 to -

  1. NKOSINATHI MPUMELELO MVINJANE (date of birth 16 March 1972); and
  2. LULAMILE KHWANKWA (date of birth 10 September 1971),

in respect of

  1. the murder of SIMON MAKHUDU KUNGOANE;
  2. the robbery of SIMON MAKHUDU KUNGOANE; and
  3. unlawful possession of firearms and ammunition namely, a 9mm Beretta, a 7.65mm automatic pistol and an unknown number of 9mm and 7.65mm ammunition, committed on or about 20 August 1991at or near Pimville, Gauteng;

(h) on 18 September 1998 to SUNNYBOY JOHANNES SIBIYA (identity number 650325 5739 08 5), in respect of the murder of VUSUMUZI EPHRAIM DHLUDHLU on or about 17 October 1992 at or near eMzinoni, Bethel, in the then Transvaal.
