Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted

  1. on 1 June 1998 to ANDRIES ZIRK GOUS (identity number 4812295001006) in respect of all offences associated with a political objective as defined in the Act and which fall within the ambit of the Act, which are associated with and flow from damage to the property of Dr. Bulbulia at Bakerton, Springs during, or about October 1989 as a result of the use of explosives, as well as offences associated with the unlawful possession of explosives that were used for that purpose;

  4. contravention of section 32(1)(b), read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of four M26 hand grenades and one M791 rifle grenade);

committed on or about 14 February 1994 at the Crazy Beat Disco, Newcastle;

(ii) WALTER FALIBANGO THANDA (date of birth 29 December 1960), in respect of-

  1. the murder of GERBRECHT SALOMINA VAN WYK;
  2. the attempted murder of an unknown number of members of the public;
  3. contravention of section 32(1)(a), read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of three R4 and one R5 machine guns);
  4. contravention of section 32(1)(e), read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of ammunition intended to be fired from a machine gun, to wit, 659 5.56 X 45mm cartridges),
  5. contravention of section 32(1Xb), read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of four M26hand grenades and one M791 rifle grenade);
  6. contravention of section 36, read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of two 9mm short cartridges, two .38 special cartridges and one .22 cartridge);

committed on or about 14 February 1994, at the Crazy Beat Disco, Newcastle, and

  1. contravention of section 2, read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of a 9mm pistol); and
  2. contravention of section 36, read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession seven 9mm short cartridges),

committed on or about 15 February 1994 at or near Madadeni in the district of Newcastle;

(iii) BONGANI GOLDEN MALEVU (identity number 6301245359084), in respect of

  1. the murder of GERBRECHT SALOMINA VAN WYK;
  2. the attempted murder of an unknown number of members of the public;
  3. contravention of section 32(1)(a), read with sections 1, 39 and 40 of Act 75 of 1969, (unlawful possession of three R4 and one R5 machine guns),

committed on or about 14 February 1994 at the Crazy Beat Disco, Newcastle;

  1. on 10 June 1998 to-

  2. BASSIE MZUKISI MKHUMBUZI (date of birth 14 May 1975); and

committed on 25 July 1993 at the St. James Church in the district of Wynberg;

The above amnesty is granted in respect of the above offences flowing from or associated with-

  1. the explosion during or about July 1991 at the Hillview High School, Corner Boom and Dr. Savage Street, Pretoria;
  2. the bombing during or about December 1991 of Cosatu House in Pretoria; and
  3. the bombing during or about January 1992 of the post offices in Verwoerdburg and Krugersdorp;
  1. on 22 June 1998 to

  1. contravention of section 32(1)(b) of Act 75 of 1969, for being in possession of four shock grenades;
  2. contravention of section 2 of the aforementioned Act, for being in possession of a home made shotgun;
  3. contravention of section 36 of Act 75 of 1969, for being in possession of ammunition without a licence but with the consent of the owners of the said ammunition; and
  4. contravention of section 2 of Act 75 of 1969 of being in possession of a Lama pistol without a licence although the said pistol was not capable of firing ammunition at the particular time,

committed on or about 15 September 1992 at or near Bloemfontein;

  1. on 15 July 1998 to -

  4. robbery with aggravating circumstances of a motor vehicle on 30 December 1993;

committed on or about 30 December 1993 at or near the Heidelberg Tavern, Station Road, Observatory;

  1. unlawful possession of Srearms and ammunition. These being an R4 or R5 rifle, an AK47 rifle, ammunition for these weapons and hand and rifle grenades on or about 30 December 1993 at or near the Heidelberg Tavern, Station Road, Observatory;
  1. on 21 July 1998 to NORMAN GILINDODA GXEKWA (date of birth 12 March 1963),

in respect of the murder of the following persons:

THANDO;
DLADLA;
MONWABISI REGINALD FANAYO; and
THOZAMILE MICHAEL DONDASHE,

during 1985 at Uitenhage, Eastern Cape;

  1. on 22 July 1998 to -

  1. the bombing of the premises of WISEMAN ZITEMBILE SANA during the night of 13 - 14 August 1993 at or near Queenstown;

  3. the unlawful possession of explosives during the period July 1993 to 13 September 1993, which explosives are described in the Regional Court, Cradock, charge sheet under case number 4/1971/93,

  1. the murder of AMY BIEHL; and
  2. the crime of public violence arising from the stoning and damaging of vehicles,

  1. the unlawful possession of 17 AK 47 firearms;
  2. the unlawful possession of 1 200 rounds of ammunition; and
  3. the unlawful possession of a hand grenade,

in contravention of Act 75 of 1969, committed during the period 1993-1994 at or near He district of Nelspruit;

  1. an 18 August 1998 to SILUMKO TILVET MAMA (identity number 5505285762087),

in respect of -

  1. arson; and
  2. public violence,

  2. contravention of section 36, read with sections 39(2) and 40 of the Act 75 of 1969, for being in illegal possession of 2092 rounds of 7,62 ammunition on or about 7 February 1994 in or near Randfontein;
  3. contravention of section 2, read with sections 39(2) and 40 of Act 75 of 1969, for being in illegal possession of a shotgun on or about 7 February 1994 in or near Randfontein;
  4. contravention of section 5, read with sections 1, 5(2) and 28 of Act 26 of 1956, for being in illegal possession of explosives on or about 2 February 1994 in or near Randfontein;
  5. theft of explosives during or about February 1994 at or near the Randfontein in Estates Goldmine, Randfontein ; and
  6. theft of and illegal possession of a R1 rifle during the period April to November 1993 in Benoni;
  1. on 21 August 1998 to -

in respect of -

  1. WANDILE MERRY DYANTI (identity number 6412265397084), and
  2. WELE SHYLOCK MATOMELA (identity number 6811205446085),

in respect of -

  1. contravention of section 27(1) of the Explosives Act No. 26 of 1956, by intentionally causing an explosion at Easigas Plant on or about 28 December 1993 in or near Port Elizabeth; and
  2. contravention of section 6 of the Explosives Act No. 26 of 1956, namely the unlawful possession of explosive material;

  1. on 21 August 1998 to ANGELO DUDLEY PETE (identity number 5101035032086), for all offences associated with a political objective committed by him during the period 1986 as a member of the South African Department of Correctional Services in connection with the aiding and abetting of the escape of Charles Sebe from Middledrift Prison; and

  1. on 21 August 1998 to ABRAM NKOSANA MASEKO (identity number 7307218374085), for the unlawful possession of ammunition in contravention of Act ?5 of 1969, during the period 1993 - 1994 in or near Sebokeng.
