PROCLAMATION

TRUTH AND RECONCILIATION COMMISSION: COMMITTEE ON AMNESTY

PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT No. 34 OF 1995)

Notice is hereby given that amnesty in terms of section 20 (1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted—

  1. on 5 November 1997 to DERRICK MHLUPHEKI SKOSANA (Identity Number 700924 5473 081), in respect of—

    (i) attempted murder of Johannes Mandla Shabangu;

    (ii) attempted murder of Noelane Lingwate;

    (iii) attempted murder of Peer Mnisi;

    (iv) attempted murder of Thadi Mokoena;

    (v) attempted murder of Lazarus Chiwayo;

    (vi) attempted murder of Phindive Shalangu;

    (vii) illegal possession of two F1 hand grenades of Russian origin;

    (viii) illegal possession of one AK47 gun with two magazines; and

    (ix) illegal possession of 148 x 7,62 mm rounds of ammunition for a machine gun,

    committed on or about 10 to 11 November 1992 at or near kaNyamazane;

  2. on 5 November 1997 to CONRAD NKUNA (Identity Number 750618 5374 08 8), in respect of—

    (i) attempted murder of Johannes Mandla Shabangu;

    (ii) attempted murder of Noelane Lingwate;

    (iii) attempted murder of Peer Mnisi;

    (iv) attempted murder of Thadi Mokoena;

    (v) attempted murder of Lazarus Chiwayo;

    (vi) attempted murder of Phindive Shalangu;

    (vii) illegal possession of two F1 hand grenades of Russian origin;

    (viii) illegal possession of one AK47 gun with two magazines; and

    (ix) illegal possession of ammunition,

    committed on 10 to 11 November 1992 at or near kaNyamazane, and—

    (x) the illegal possession of an F1 hand grenade of Russian origin;

    (xi) the illegal possession of 20 x 7,62 mm rounds of ammunition for an AK47 gun; and

    (xii) the illegal possession of 1 x 7,62 mm round of ammunition,

    committed on or about 3 December 1992 at or near kaNyamazane;

  3. on 5 November 1997 to JOSEPH HAROLD NKUNA (Identity Number 651125 5496 08 5), in respect of—

    (i) attempted murder of Johannes Mandla Shabangu;

    (ii) attempted murder of Noelane Lingwate;

    (iii) attempted murder of Peer Mnisi;

    (iv) attempted murder of Thadi Mokoena;

    (v) attempted murder of Lazarus Chiwayo; and

    (vi) attempted murder of Phindive Shalangu;

    committed on or about 10 to 11 November 1992, at or near kaNyamazane, and—

    (vii) the illegal possession of two F1 hand grenades of Russian origin;

    (viii) the illegal possession of one AK47 gun with two magazines;

    (ix) the illegal possession of 148 x 7,62 mm rounds of ammunition for a machine gun;

    (x) the illegal possession of one F1 hand grenade;

    (xi) the illegal possession of 20 x 7,62 mm rounds of ammunition for an AK47 gun; and

    (xii) the illegal possession of 1 x 7,62 mm round of ammunition,

    committed during or about November/December 1992 at or near kaNyamazane;

  4. on 28 November 1997 to the following persons in respect of the acts, offences, omissions and delicts flowing from and connected with the illegal entry of the ANC offices at Pietersburg and Cosatu House at Pretoria, during the period 1990 to 1992:

    (i) DIETER STOLS (Identity Number 580501 5061 00 0);

    (ii) FREDERIK HENDRIK GEYSER (Identity Number 600504 5047 00 1);

    (iii) PIETER BESTER (Identity Number 650330 5063 08 0);

    (iv) THEUNIS HANNES GERBER (Identity Number 690707 5037 08 4); and

    (v) WILHELM JOHAN ELS (Identity Number 510909 5006 00 7);

  5. on 28 November 1997 to TREVOR ARMSTRONG THAMSANGA TUTU (Passport No. L4719), in respect of the contravention of section 2 (2) (b) and section 2 (1) (g), read with section 1, of the Civil Aviation Act, 1972 (Act No. 10 of 1972), committed at East London on 8 October 1989 and in respect of which he was sentenced in the Regional Court at East London under Case Number SH 2/229/89, and any other offences or omissions flowing from the afore-mentioned contravention;

  6. on 27 November 1997 to MODODA SHACKLETON KULA (Identity Number 621288 5637 08 3), in respect of—

    (i) the possession of explosives in contravention of section 27 (1) (c) of the Explosives Act, 1956 (Act No. 26 of 1956); and

    (ii) the possession of a hand grenade in contravention of section 29 (1) of the Explosives Act, 1956 (Act No. 26 of 1956),

    committed on or about 22 October 1992 at Msomohvu Administration Area, in the District of Alice;

  7. on 3 December 1997 to HENDRIK JOHANNES SLIPPERS (Identity Number 620413 5132 08 4), in respect of the abduction of George Ngomane on our about 13 February 1991 in the District of Belfast;

  8. on 11 December 1997 to OLOF VORSTER (Identity Number 691127 5073 08 0), for all offences charged with, found guilty of and which fall within the ambit of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1994), as a member of the Conservative Party/Volksfront and on its behalf, committed during 1993 and 1994 in the District of Pretoria; and

  9. on 15 December 1997 to MOSES NDABAPHI (Identity Number 581119 5295 08 9), for all offences associated with a political objective as defined by the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), and which fall within the ambit of that Act, committed as a member of the African National Congress and on its behalf, relating to the illegal possession and distribution of firearms and ammunition in and near Soweto and the surrounding squatter camps during 1990.
