PROCLAMATION

ASSIGNMENT OF ADMINISTRATION OF LAWS TO PROVINCES UNDER ITEM 14 (1) OF SCHEDULE 6 TO THE CONSTITUTION OF THE REPUBLIC OF SOUTH AFRICA, 1996

In terms of item 14 (1) of Schedule 6 to the Constitution of the Republic of South Africa, 1996 (Act No. 108 of 1996) (hereinafter referred to as the "Constitution"), I hereby assign the administration of—

  1. sections 24A (3), 34 (2), 41 (2), 62 (3), 63 (2) and 139 of the Road Traffic Act, 1989 (Act No. 29 of 1989), only with respect to the determination of fees in terms of the said sections;
  2. section 132, including subsection (1) (w), of the Road Traffic Act, 1989, with respect to the determination of fees in terms of that section for the purposes of the sections mentioned in paragraph (a); and
  3. section 150 of the Road Traffic Act, 1989, in so far as this section relates to any fees prescribed in terms of any section of that Act assigned under this Proclamation,

excluding those provisions (if any) of the said Act specified above which do not fall within the functional areas specified in Schedule 4 or 5 to the Constitution, to an authority within a provincial executive designated by the Executive Council of the province concerned.
