The Chairperson of the South African Telecommunications Regulatory Authority, Mr. Nape Maepa has recused himself from the deliberation and adjudication of the third cellular license process, Minister of Communications Dr. Ivy Matsepe-Casaburri said on Monday.
Mr. Maepa recused himself in a letter to the President, copied to the Minister, because a former business associate of his, is a trustee in one of the foundations associated with an applicant.
Although, Mr. Maepa does not have a conflict of interest, he stepped down to clear any perception that might arise because of his past association with an interested party in the outcome of the process.
All SATRA Councilors had made affidavits declaring any interest in the bidding consortia, following allegations that some of the Councilors were linked to bidders.
Mr. Maepa had disclosed his association with a past business partner, who could have an indirect interest in one of the bidders and had offered to recuse himself, if this partner had an association that could lead to the perception that a conflict of interest existed.
Mr. Maepa's recusal does not imply any guilt on his part, but is a courageous decision to ensure that the outcome of the process is beyond reproach.
"I have welcomed Mr. Maepa's decision and wish to reassure bidders that the third cellular license process will be concluded within the outlined timetable at the end of March 2000, " Dr. Matsepe-Casaburri said.
Mr. Maepa's recusal still leaves the Council with a quorum and would thus not prejudice both the deliberations and the outcome of the process, however, reduces the prospect of litigation which could further delay the licensing process, she said.
