STATEMENT ON REFERAL OF THE LIQUOR BILL

The Office of the President confirms that, in terms of section 79(4)(b) of the Constitution, 1996, the President has referred the Liquor Bill on 8 March 1999 to the Constitutional Court for a decision on its constitutionality. The issue which prompted the President to refer this Bill to the Constitutional Court relates to uncertainty regarding the Bill's compliance with the requirements of section 44(2)(b) - (e) of the Constitution, 1996. In the absence of any jurisprudentially or constitutional guidelines regarding these provisions it was necessary to refer the Bill to the Constitutional Court as aforesaid.

The Constitutional Court will as determine the means by which any interested parties may make representations to the court in regard thereto.
