Issued by: Ministry of Health
13 July 1998
Health Minister, Dr Nkosazana Zuma, has on behalf of the government, welcomed the court's ruling on Choice on Termination of Pregnancy Act 72 of 1996, as a victory for all South African women.
In the matter where the constitutionality of the Act was challenged, the court upheld an exception raised by the Respondents and dismissed plaintiffs' claims, on the basis that their particulars of claim do not make out a cause for action.
The court ruling will remove uncertainties around the legality of termination of pregnancy and help assert women's right to choose and take decisions affecting their lives.
The Minister has pledged to continue developing policies aimed at improving the quality of life of all South Africans, particularly women, children and the disabled.
She has appealed to the religious community, the trade union movement, business and other formations, to work with government in realisinfor all.
