END RACISM IN THE WORKPLACE

The Public Service Commission has found in favour of the Director-General of Department of Labour Mr Sipho M Pityana in an appeal lodged by a former employee Ms E M Niemand who was dismissed for using racist remarks.

The Department of Labour has dismissed an official Ms E M Niemand for misconduct related to racism in terms of section 22 (2) of the Public Service Act, 1994 on three counts for allegedly having called his supervisor Mr J Mela a "Kaffir".

The officer appealed against the decision of the Director-General, Mr Sipho M Pityana to the office of the Public Service Commission. In its finding the Public Service Commission view of the fact that the aggravating circumstances far outweigh the mitigating circumstances presented, directed in terms of section 26(3) (b) of the Public Service Act, 1994, the officer's appeal was dismissed.
