SETTLEMENT REACHED IN LAND CLAIMS COURT

The Land Claims Court today confirmed an agreement between Oragrove Farms CC and 33 other applicants and the Regional Land Claims Commissioner for the Northern Province, Gauteng, Mpumalanga and North West regarding a land claim instituted by the Mmaboi community on land in the Pietersburg district.

In terms of the settlement the Regional Land Claims Commissioner will withdraw a notice in the Government Gazette published on 8 September 1995 in terms of which the Mmaboi claim on extensive parcels of land in the vicinity of Pietersburg was accepted for further investigation and public notice. The effect of withdrawal of the official notice will be that restrictions placed on transactions with the claimed land in terms of section 11(7) of the Restitution of Land Rights Act, 1994, will be removed. The amending official notice will be published in the Government Gazette on August 2, 1996.

It should be noted that the withdrawal of the official notice of 8 September 1995 does not mean that the claim by the Mmaboi community is set aside or rejected. It only implies that the Mmaboi claim will have to be further investigated before a decision is made by the Regional Land Claims Commissioner whether it is a valid claim in terms of the Act or not.
