Pending the restructuring of the Legal Aid Board and amendments to the law in this regard I have decided that, in the meantime, the present Board should continue in office, except that Advocate Coetzee will be replaced by Advocate Epstein.
It should be noted in this regard that Section 25 of the Constitution provides for the right to consultation with a legal practitioner and legal representation. There is thus an obligation on the state to make funds available for administration by the Legal Aid Board.
Due to the necessity to manage funds in a responsible way, necessary and reasonable limits have been placed on the assistance available. This does not preclude the raising of these limits in exceptional cases and criteria in this regard will be developed by the Board.
