PUBLICATION OF EXPLANATORY SUMMARY OF THE ROAD ACCIDENT FUND COMMISSION AMENDMENT BILL

The Minister of Transport intends introducing the Road Accident Fund Commission Bill in the national Assembly early in March 2000. The explanatory summary of the Bill is hereby published in accordance with Rule 241 (c) of the Rules of the National Assembly.

The Bill provides for:

To amend the Road Accident Fund Commission Act,1998, so as to provide afresh for the duties of the Commission with regard to its inquiry in terms of section 5(1); to extend the period within which its report has to be submitted to the President; and to provide for the extension of that period by the President; and to provide for matters incidental thereto.

BILL

To amend the Road Accident Fund Commission Act, 1998, so as to provide afresh for the duties of the Commission with regard to its inquiry in terms of section 5(1); to extend the period within which its report has to be submitted to the President; and to provide for the extension of that period by the President; and to provide for matters incidental thereto.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:—

Amendment of section 7 of Act 71 of 1998

  1. Section 7 of the Road Accident Fund Commission Act, 1998 (Act No. 71 of 1998) is hereby amended—
  1. by the substitution for subsection (1) of the following subsection:

"(1) The Commission must [complete] , after completion of the inquiry referred to in section 5(1) [within a period of nine months from the date of appointment of the members of the Commission in terms of section 3(1)] , prepare a written report containing its findings and conclusions. and the recommendations referred to in section 5(2);";

  1. by the deletion of subsection (2); and
  2. by the substitution for subsection (4) of the following subsection:

"(4) (a) The Commission must submit its report to the President within a period of [three] 24 months from the [completion of the enquiry] date of appointment of the members of the Commission.

(b) The President may. by proclamation in the Gazette, extend the period referred to in paragraph (a) if the Commission requests the extension of the period in writing."

Short title

  1. This Act is called the Road Accident Fund Commission Amendment Act, 2000, and must be regarded as having taken effect on 1 June 1999.
