No. 574 9 June 2000 This Government Notice supersedes Government Notice No. 384 published in Government Gazette No. 21067 of 14 April 2000:

INDEPENDENT COMMISSION FOR THE REMUNERATION OF PUBLIC OFFICE BEARERS

RECOMMENDATIONS ON THE SALARIES, ALLOWANCES AND BENEFITS OF PUBLIC OFFICE-BEARERS

  1. The Independent Commission for the Remuneration of Public Office Bearers was constituted in terms of Section 219 of the Constitution of the Republic of South Africa, 1996. It was duly appointed in terms of the Independent Commission for the Remuneration of Public Office Bearers Act, 1997 with the objective of making recommendations regarding the salaries, allowances and benefits of public office-bearers.

  2. In terms of Section 8 of the Independent Commission for the Remuneration of Public Office-Bearers Act, 1997, the Independent Commission herewith publishes its recommendations concerning the salaries, allowances and benefits for office-bearers.

  3. With due regard to the submissions received and information available to the Independent Commission and having considered the other relevant factors, the Commission makes the following recommendations for consideration:

3.1 Grading Structure

The Grading Structure for members of the National Assembly, of the National Council of Provinces (NCOP) and of Provincial Legislatures as set out in Annexure A, be approved.

3.2 President

The total remuneration package of the President be increased by resolution of the National Assembly to R789 574 per annum with effect from 1 April 2000.

3.3 The Remuneration for Members to the National Assembly and Permanent Delegates to the National Council Of Provinces (NCOP)

A Three Notch Remuneration Structure as a total package in accordance with Annexure B be implemented with effect from 1 April 2000 and which provides the following:

  1. Notch 1

Applicable to newly elected members to an institution during the 1999 election.

  1. Notch 2

Applicable to members re-elected during the 1999 election to the same institution with less than two years continuous service in a position in the institution.

  1. Notch 3

Applicable to members re-elected during the 1999 election with more than two years continuous service in the same position to the same institution. Office-bearers remunerated on Notch 2 should be promoted automatically to Notch 3 after completion of two years continuous service in the relevant position.

3.4 The upper limit of the remuneration for Members to any Provincial Legislature

3.4.1 A Three Notch Remuneration Structure as a total package in accordance with Annexure B be determined as upper limits by the President for implementation with effect from 1 April 2000 and which provides the following:

  1. Notch 1

Applicable to newly elected members to a Provincial Legislature during the 1999 election.

  1. Notch 2

Applicable to members re-elected during the 1999 election to the same Provincial Legislature with less than two years continuous service in a position in the Legislature.

  1. Notch 3

Applicable to members re-elected during the 1999 election with more than two years continuous service in the same position to the same institution. Office-bearers remunerated on Notch 2 should be promoted automatically to Notch 3 after completion of two years continuous service in the relevant position.

3.4.2 The following allowances/benef~ts be discontinued with immediate effect:

  1. The reimbursement of members for travelling by road or air for journeys other than -
  1. proceeding from his/her home base to the Legislature at the beginning of a session and back to home base at the end of a session;

  2. attending committee meetings of a legislature during a recess; and

  3. performing official functions on behalf of the legislature away from the seat of the legislature;

  1. The granting of an once-off allowance to members to purchase a cellular phone that becomes the sole property of a member without payment for the instrument;

  2. The payment of a housing allowance or allowances for accommodation at the seat of a legislature to attend official sessions at the seat of the legislature and

  3. The allocation of air-tickets for private use by an office-bearer, his/her spouse/companion or dependent family members.

3.4.3 It is recommended that Provincial Legislatures should forthwith take the necessary steps to standardise and legitimise the allocation of resources directed at enabling office bearers to perform their representative functions. Such provisions should comply with the principles of good public governance and should not constitute indirect remuneration.

3.5 Traditional Leaders

3.5.1 National House of Traditional Leaders

The daily allowance and subsistence for the Chairperson, Vice Chairperson and members of the National House of Traditional Leaders, be increased by 5% for the 2000/01 financial year.

3.5.2 Provincial Houses of Traditional Leaders

The daily allowance and subsistence for the Chairperson, Vice Chairperson and members of the Provincial Houses of Traditional Leaders, be increased by 5% for the-2000/01 financial year.

3.5.3 Kings. Chiefs and Headmen

The annual remuneration of Kings, Chiefs and Headmen be increased by 5% for the 2000/01 financial year.

3.6 Transitional Local Government Institututions

3.6.1 The upper limit of the annual remuneration of members of Transitional Local Government Institutions to be determined by the Minister for Provincial Affairs and Local Government, be increased by 5% of the present annual remuneration of office-bearers for the next local government financial year.

3.6.2 The Minister for Provincial Affairs and Local Government, in consultation with Members of Executive Councils of Provinces responsible for Local Government, take appropriate steps to terminate allowances awarded by Transitional Local Government Institutions to themselves that exceed the legally prescribed maxima by the relevant authorities.
