DEPARTMENT OF TRANSPORT
PUBLICATION OF EXPLANATORY SUMMARY OF NATIONAL LAND TRANSPORT
TRANSITION BILL
The Minister of Transport intends introducing the National Land Transport Transition
Bill in Parliament during February 2000. An explanatory summary of the Bill is hereby
published in accordance with Rule 241 (1)(c) of the Rules of the National Assembly and
Rule 186(1)(b) of the Rules of the National Council of Provinces.
The Bill provides for the transformation and restructuring of the land transport system
of the Republic in the short term by:
- providing principles for national land transport policy and for the publication of such
policy;
- the setting of national norms and standards and the issuing of regulations on land
transport by the Minister of Transport, and the setting of provincial norms and standards
and the issuing of provincial regulations on land transport by the Members of the
Executive Councils of Provinces (MECs) responsible for land transport;
- providing for the establishment and functions of transport authorities in the third
sphere of government, to effect improved transport service delivery in the local sphere of
government by grouping transport functions into a single, well-managed and focussed
institutional structure;
- providing for interim funding arrangements for land transport;
- providing a framework and detailed requirements for the drafting of Transport Plans, to
form part of the Integrated Development Plans of municipalities;
- providing for Provincial Permissions Boards to issue permissions as authorisations to
undertake public transport;
- providing a framework and requirements for the payment of subsidies to providers of land
public transport;
- providing for the regulation and control of operators of public transport services
- providing for the registration of associations and operators of minibus taxi-type
services, and providing a framework for eventual registration in relation to other types
of services;
- providing for new categories of vehicles used for public transport services, to enable
implementation of the proposed taxi recapitalisation project;
- providing for additional powers of law enforcement officers and measures to streamline
land transport law enforcement; and
- providing for incidental matters.
