DEPARTMENT OF TRADE AND INDUSTRY

INVITATION BY THE MINISTER OF TRADE AND INDUSTRY FOR NOMINATIONS OF PERSONS FOR APPOINTMENT AS CHAIRPERSON OF THE NATIONAL GAMBLING BOARD

In terms of section 3(3) of the National Gambling Act, 1996 (Act No.33 of 1996), the Minister of Trade and Industry hereby invites nominations of persons as candidates for the Chairperson of the National Gambling Board as contemplated in section 3(1)(a) of the Act.

The person referred to in section 3(1)(a) shall be appointed only after the Minister of Trade and Industry has through the media and by notice in the Gazette invited nominations of persons as candidates for a position as the Chairperson of the Board, and the parliamentary committees concerned have made recommendations to the Minister in relation thereto after a transparent and open process of considering persons so nominated, having due regard to the objects of the National Gambling Act as set out in section 10 of the Act.

It must be emphasised that section 3(7)(a) of the Act stipulates that a person shall not be appointed as a member or remain to be a member of the Board -

  1. unless he or she is a fit and proper person;
  2. if such a person, whether personally or through his or her spouse, partner or associate-
  1. has or acquires a direct or indirect financial interest in any activity related to the objects of the Board; or
  2. has or acquires any interest in any business or enterprise that may conflict or interfere with the proper performance of his or her duties as member of the Board;
  1. if such person
  1. is or becomes a political office-bearer;

  2. is an unrehabilitated insolvent, or becomes insolvent and the insolvency results in the sequestration of his or her estate;

  3. has at any time been, or is removed from an office of trust on account of misconduct; or

  4. has at any time been or is convicted, whether in the Republic or elsewhere, of theft, fraud, forgery or uttering a forged document, perjury, an offence under the Corruption Act, 1992 (Act No. 94 of 1992), or any offence involving dishonesty.

Note that "political office-bearer" means a person as defined in section 190A of the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993), including members of Provincial Houses of Traditional Leaders, the Council of Traditional Leaders, the Volkstaat Council, and local government, and an official of any political party.

Nominations should be submitted to the Minister of Trade and Industry in writing within fourteen (14) days of the publication of this notice-

Nominations should be accompanied by a comprehensive curriculum vitae and a written statement in which the nominee declares whether or not he or she has any interests as referred to in section 3(7)(a)(ii) of the Act and whether or not he or she is disqualified for appointment in terms of section 3(7)(a)(iii) of the Act.

Please note that all nominees might at a later stage be requested to complete a questionnaire in order to determine substantiation of the suitability and eligibility of each nominee and the relevant committees of the Parliament of the Republic of South Africa will be empowered to interview nominees pursuant to section 3(3) of the National Gambling Act.
