ELECTORAL COMMISSION
DETERMINATION OF SEATS FOR THE NATIONAL ASSEMBLY AND PROVINCIAL
LEGISLATURES
The Electoral Commission hereby gives notice that
- In terms of sections 46(2) and 105(2) of the Constitution, 1996, read with section 114
of, and Schedule 3 to, the Electoral Act, 1998 (Act No. 73 of 1998), the Electoral
Commission must determine the number of members of the National Assembly and of each of
the provincial legislatures.
- In terms of Item 1 of Schedule 3 to the Electoral Act, 1998, the Electoral Commission
must determine the number of seats of the National Assembly and each of the provincial
legislatures according to a formula specified in the item, taking into account available
scientifically based data and representations by interested parties.
- In terms of Item 2(a) of Schedule 2 to the Interim Constitution, 1993, as amended by the
Constitution, 1996, one had of the seats in the National Assembly to be filled from
regional lists, with a fixed number of seats reserved for each region, must be determined
by the Commission taking into account available scientifically based data in respect of
voters, and representations by interested parties.
- In terms of Item 3(2) of Schedule 3 to the Electoral Act, 1998, the Electoral Commission
hereby gives notice that the determination contemplated in paragraphs (a) - (c) above will
take place at the following venue, date and time:

- Interested parties are hereby invited to make proposals regarding the scientifically
based data to be taken into account by the Electoral Commission by not later than 12
February 1999.
- The Electoral Commission undertakes to forward copies of all other proposals received
from interested parties to those who responded to this invitation by not later than 19
February 1999.
- Interested parties who were forwarded copies of other proposals may make further inputs
on those proposals and forward their responses to the Electoral Commission by not later
than 5 March 1999.
- All proposals and responses must be forwarded to the Electoral Commission at one of the
