NOTICE 2324 OF 1998

DEPARTMENT OF TRADE AND INDUSTRY

HARMFUL BUSINESS PRACTICES ACT, 1988

I, Alexander Erwin, Minister of Trade and Industry, do hereby, on recommendation of the Business Practices Committee and in terms of section 12 (4) (d) of the Harmful Business Practices Act, 1988 (Act No. 71 of 1988), amend General Notice No. 1555 published in Govemment Gazette No. 17540 of 30 October 1996, as set out in the Schedule.

SCHEDULE

1. The definition of Harmful business practice" is deleted and substituted by the following: " 'harmful business practice' means to directly or indirectly—
   1. invite any person to make an investment in the companies; or
   2. receive investment funds from any person for investment of such funds on behalf of the investor in the companies; or
   3. sell shares to any person in any of the companies or in any assets of the companies.
2. The following definition is inserted therein immediately after the definition of "harmful business practices: " 'the companies' means the eight companies listed hereunder in the definition of 'the parties'."
3. General Notice No. 132 of 1998 published in Govemment Gazette No. 18635 of 30 January 1998 is hereby repealed.

4. This notice shall come into operation upon the date of publication hereof.
