It is hereby notified that the President has assented to the following Act which is hereby published for general information:-

To amend the University of Durban-Westville Act, 1983, so as to further regulate the constitution of the senate; and to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Amendment of section 8 of Act 81 of 1983, as amended by section I of Act 51 of 1993

1. Section 8 of the principal Act is hereby amended-

(a) by the substitution for paragraph (g) of subsection (1) of the following paragraph:

"(g) two persons who are members of the staff of the University elected in a manner determined by the council, one of whom shall be a member of the teaching staff elected from their number and the other a member of the non-teaching staff elected from their number;"; and

(b) by the substitution for paragraph (d) of subsection (5) of the following paragraph:

"(d) accepts a permanent appointment to a post on the establishment of the University, except in the case of a member contemplated in subsection (1)(c) or (h) (g).".

Amendment of section 9 of Act 81 of 1983

2. Section 9 of the University of Durban-Westville Act, 1983, is hereby amended-

(a) by the substitution for paragraph (d) of subsection (1) of the following paragraph:

"(d) the such professors of the University and as are not heads of departments and as the council may from time to time designate;";

(b) by the addition to subsection (1) of the following paragraphs:

"(f) two members, who may be members of the staff of the University, elected by the convocation from among its number;

(g) two members of the students' representative council of the University nominated by the students' representative council; and

(h) one member elected by each faculty standing committee of the students' representative council from among the number of each committee in a manner determined by the students' representative council.".

Transitional provision

3. The members of the council and the senate of the University of Durban-Westville who served in the council by virtue of section 8(1)(g) or in the senate by virtue of section 9(1)(d) of the University of Durban-Westville Act, 1983 (Act No. 81 of 1983), before the date of commencement of this section, shall cease to be members of the council or the senate, as the case may be, from the said date.

Short title and commencement

4. This Act shall be called the University of Durban-Westville (Private) Amendment Act, 1996, and shall come in to operation on a date fixed by the President by proclamation in the Gazette.
