AGRICULTURAL CREDIT AMENDMENT ACT

It is hereby notified that the President has assented to the following Act which is hereby published for general information:-

ACT

To amend the Agricultural Credit Act, 1966, so as to make it applicable throughout the Republic; and to replace or delete certain definitions and expressions; and to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 28 of 1966, as amended by section 1 of Act 45 of 1968, section 1 of Act 66 of 1970, section 1 of Act 27 of 1980, section 1 of Act 73 of 1981, section 1 of Act 67 of 1982, section 1 of Act 42 of 1983 and section 1 of Act 51 of 1987

1. Section 1 of the Agricultural Credit Act, 1966, as assigned to the Minister of Agriculture by Proclamation No. R. 19 of 26 March 1993 (hereinafter referred to as the principal Act), is hereby amended-

(a) by the substitution for the definition of "department" of the following definition:

" 'department' means the Department of Agriculture [and Water Supply: Administration: House of Assembly];";

(b) by the substitution for the definition of "Director-General" of the following definition:

" 'Director-General' means the Director-General: [Administration: House of Assembly] Agriculture;";

(c) by the deletion of the definition of "head of the Department"; and

(d) by the substitution for the definition of "Minister" of the following definition:

" 'Minister' means the Minister of Agriculture [and Water supply];"

Amendment of section 20A of Act 28 of 1966, as amended by section 4 of Act 73 of 1981 and section 18 of Act 51 of 1987

2. Section 20A of the principal Act is hereby amended by the substitution for paragraph (a) of subsection (5) of the following paragraph:

"(a) are not required for the purposes mentioned in subsection (3), shall be transferred to the [Revenue Account: House of Assembly of the State] National Revenue Fund;".

Amendment of section 49 of Act 28 of 1966, as substituted by section 36 of Act 51of 1987

3. Section 49 of the principal Act is hereby amended by the substitution for subsection (2) of the following subsection:

"(2) The Director-General [or the head of the department] may with the consent of the Minister delegate to any other officer in the department any power conferred upon the Director-General [or the head of the department] by this Act.".

Substitution of certain expressions in Act 28 of 1966

4. The principal Act is hereby amended-

(a) by the substitution for the expression "head of the department", wherever it occurs, of the expression "Director-General";

(b) by the substitution for the expression "Minister of the Budget", wherever it occurs, of the expression "Minister of Finance"; and

(c) by the substitution for the expression "the House of Assembly", wherever it occurs, of the expression "Parliament".

Insertion of section 55 in Act 28 of 1966

5. The following section is hereby inserted in the principal Act after section 54:

"Application of Act

55. This Act shall apply throughout the Republic.".

Short title and commencement

6. This Act shall be called the Agricultural Credit Amendment Act, 1995, and shall be deemed to have come into operation on 27 April 1994.
