RECOGNITION OF FOREIGN LEGAL QUALIFICATIONS AND PRACTICE AMENDMENT ACT

NO. 10 OF 1995: RECOGNITION OF FOREIGN LEGAL QUALIFICATIONS AND PRACTICE AMENDMENT ACT, 1995
It is hereby notified that the President has assented to the following Act which is hereby published for general information:-

ACT
To amend the Recognition of Foreign Legal Qualifications and Practice Act, 1993, so as to effect certain textual adjustments; and to make further provision for the exemption of certain persons from certain requirements contained in the Admission of Advocates Act, 1964, and the Attorneys Act, 1979; and to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-
Amendment of section 2 of Act 114 of 1993
1. Section 2 of the Recognition of Foreign Legal Qualifications and Practice Act, 1993, is hereby amended- (a) by the substitution in the Afrikaans text for subparagraphs (i) and (ii) of paragraph (b) of subsection (1) of the following subparagraphs:
"(i) diens kragtens 'n leerkontrak bedoel in artikel 2 van die Wet op Prokureurs, 1979, en van die bepalings van artikel 15 (1) (b) (vi) of 18(1)(d) van daardie Wet;
(ii) 'n praktiese eksamen bedoel in artikel 14 van die Wet op Prokureurs, 1979, en van die bepalings van artikel 15 (1) (b) (iv) of 18(1)(d) van daardie Wet."; and
(b) by the substitution for paragraph (a) of subsection (2) of the following paragraph:
"(a)(i) the applicant is a South African citizen who left the Republic at some stage and that such applicant lawfully and permanently returned to the Republic or declared his or her intention to so return to the Republic within a reasonable time; or
(ii) the applicant is the spouse or a child of a South African citizen, which citizen left the Republic at some stage and lawfully and permanently returned to the Republic or declared his or her intention to so return to the Republic within a reasonable time, and that such applicant lawfully and permanently entered the Republic or declared his or her intention to so enter the Republic within a reasonable time; and".
Short title
2. This Act shall be called the Recognition of Foreign Legal Qualifications and Practice Amendment Act, 1995.
