It is hereby notified that the President has assented to the following Act, which is hereby published for general information:

Words in italic indicate insertions in existing enactments.

To amend the Local Government Transition Act, 1993, so as to empower the President to amend the said Act by proclamation in the Gazette; and to provide for the validation of the extension by the Administrator of a specific period; and to provide for incidental matters.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Insertion of section 16A in Act 209 of 1993

1. The following section is hereby inserted in the Local Government Transition Act, 1993, after section 16:

"President may amend Act by proclamation

16A. (1) The President may amend this Act and any Schedule thereto by proclamation in the Gazette.

(2) No proclamation under subsection (1) shall be made unless it is approved by the select committees of the National Assembly and the Senate responsible for constitutional affairs.

(3) A proclamation under subsection (1) shall commence on a date determined in such proclamation, which may be a date prior to the date of publication of such proclamation.

(4) (a) The Minister shall submit a copy of a proclamation under subsection (1) within 14 days after the publication thereof to Parliament.

(b) If Parliament by resolution disapproves of any such proclamation or any provision thereof, such proclamation or provision shall cease to be of force and effect, but without prejudice to the validity of anything done in terms of such proclamation or such provision before it so ceased to be of force and effect, or to any right or liability acquired or incurred in terms of such proclamation or such provision before it so ceased to be of force and effect."

Validation of extension of time by Administrator

2. No extension of time which the Administrator allowed in terms of section 7(l) of the Local Government Transition Act, 1993 (Act No. 209 of 1993), before the commencement of this Act, shall be invalid by reason only of such extension being granted after the expiry of the period of 90 days referred to in that section.

Short title

3. This Act shall be called the Local Government Transition Act Amendment Act, 1994.
