FOREWORD

REPORT OF THE COMMISSION OF INQUIRY INTO THE INCIDENTS THAT LED TO THE VIOLENCE IN THE FORMER BOPHUTHATSWANA ON 11 MARCH 1994 AND THE DEATHS THAT OCCURRED AS A RESULT THEREOF

This report consists of eight parts.

The first part will be an introductory section in regard to the appointment, composition, terms of reference and activities of the Commission and a setting out of the legal principles which the Commission observed in considering the incidents that led to the violence in the Mmabatho/Mafikeng area of the former Bophuthatswana on 10 and 11 March 1994.

The second part is a summary followed by a full, detailed and comprehensive setting out of the background to the events that led to that violence.

The third part is a summary of the identity of those who died in the Mmabatho/Mafikeng area as a result of that violence, the causes and circumstances of the various deaths and whether there is any prima facie criminal responsibility on the part of any person or persons for the deaths.

The fourth part is also a full, detailed and comprehensive setting out of the evidence presented before the Commission in regard to each one of the deaths in the Mmabatho/Mafikeng area investigated by the Commission.

The fifth part is a similar setting out of the background to, and the evidence in respect of, the deaths in the areas of the former Bophuthatswana other than the Mmabatho/Mafikeng area. The sixth part is also a full, detailed and comprehensive setting out of the evidence in regard to each such death.

The seventh part is an evaluation by the Commission of the responsibility for the incidents that led to the violence and for the deaths that occurred as a result thereof and its findings, recommendations and conclusions in regard thereto.

The eighth part consists of sundry matters namely the question of compensation of victims, the concerns of Amnesty International and the Commission's expressions of appreciation to whose who assisted it.
