In July, the Enlarged Board of Appeal (EBoA) of the European Patent Office (EPO) published its decision regarding G1/23, providing further clarity on the scope of prior art and the meaning of “available to the public”. The decision addresses a key question under Article 54(2) of the European Patent Convention (EPC), namely whether the public disclosure of a product that cannot be reverse engineered should still be regarded as part of the prior art. Background to the Decision

The dispute centres on Satéur’s “Mickey 1928 Collection”: a range of jewellery depicting the version of Mickey featured in Steamboat Willie – imagery that Disney claims shines a little too brightly with its own intellectual property (“IP”).

These standard terms serve as a measure of whether a person has acted with the requisite care reasonably or typically expected of someone in their role / position.
