South Africa is scheduled to hold an election in 2024. It is a much-anticipated one, since speculation is rife that the ANC may likely lose its overall majority and be forced to govern in “coalition”. But we can never know this until after the election is held. Nevertheless, this is oft-repeated as a truism by political parties, uncritical reporters and commentators in the media, and by proponents of coalitions. This is presented as a fait-accompli without even waiting for the results of an ...

Governance and regulatory architectures ought not to be chopped and changed for their own sake. And certainly not too frequently. Except in instances where changes are necessary to enhance processes of governance and the experience of government by citizens. Change should serve a purpose, otherwise it can prove to be destabilising and disruptive to society. Something as basic as the electoral system – the process by which people in society select and confer power and authority on others for ...

2021 is the year that local government elections were to be held. As per Section 159 of the Constitution, Act 108 1996, “Terms of Municipal Councils” – The term of a municipal council may be no more than four years, as determined by national legislation” and the Local Government : Municipal Structures Act 117 of 1998, in Section 24 prescribes that “the term of municipal councils is five years, calculated from the day following the date set for the previous election of all municipal councils”. The elections must therefore be held within 90 days of the date of the expiry of the term of municipal councils, hence a term of 5 years and 90 days. Considering, that the last local government elections were held on the 3rd of August 2016, a date sometimes in the first week of November 2021 would be the maximum period to which the current term of office of municipal councils could extend without being constitutionally delinquent.
