            <description><![CDATA[In its recent judgment in Famous Idea Trading 4 (Pty) Ltd t/a Dely Road Courier Pharmacy v Government Employees Medical Scheme 2026 (4) BCLR 291 (CC), the Constitutional Court confirmed the stringent conditions that apply to review applications in respect of commercial decisions of private entities. In doing so, the Court endorsed the use of preliminary objections by such commercial entities to make quick work of unmeritorious review applications that may jeopardise the confidentiality of commercially sensitive information.]]></description>

            <description><![CDATA[Probation has always been understood as a trial period. The employee is being assessed. Nothing is guaranteed. If things do not work out and the right process is followed, they part ways cleanly. The established position reflected that reality. If an employer terminated a probationary employee without following proper procedure, it compensated them for the remaining probation period – not the whole contract. That was proportionate.]]></description>

            <description><![CDATA[A recent decision by the Labour Court provides guidance on the enforceability of contractual provisions that restrict employees from seeking alternative employment. In the matter between Lucchini South Africa (Pty) Ltd v CCMA and Others the Labour Court upheld the decision by the Commission for Conciliation, Mediation and Arbitration (CCMA) that found the employee’s dismissal for breaching such a clause to be substantively unfair. However, the Court reduced the compensation awarded to the employee from 12 months to six months’ remuneration.]]></description>
