Our law does not give parties to a cohabitation arrangement automatic legal rights and if one party wishes to claim from the other, they would need to prove that the cohabitation amounts to a universal partnership. Universal Partnerships Universal partnerships are instances where there is an express or, more often than not, a tacit agreement between two unmarried parties who live together for an extended period of time. Usually, these parties share similar responsibilities, duties and obligations as married couples which often includes income, expenses and assets.             <description><![CDATA[The importance of a distinctive feature of a trademark was emphasised by Goliath J in the present High Court decision. The applicant in this matter, Discovery Holdings Limited (“Discovery”) was registered as the owner of the trademark in question, ‘Escalator Funds’. Through a trademark search and various internet searches, the applicant discovered that Sanlam Limited (“Sanlam”) had been using the term ‘Escalating Fund’ to describe a service it provided that was, in essence, identical to Discovery’s Escalating Funds. It was common cause that the Discovery Group and Sanlam Group were direct competitors in the financial services industry and that their fields of activity overlapped.]]></description>

The corporate opportunity rule relates to a duty that exists on directors of a company to not intentionally take the opportunity for their own benefit or to the company’s detriment. At common law Under certain circumstances, a general duty is placed on directors to acquire economically beneficial opportunities on behalf of their company, which could include property or rights.             <description><![CDATA[The Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, 19 of 1998 (“PIE”) applies to everyone who occupies land without the express or tacit consent of the owner or the person in charge. One cannot simply evict someone that is illegally occupying their land. PIE makes it a pre-requisite to have a court order before any eviction takes place. PIE applies to both people who occupied land lawfully at some point in the past but who no longer have the consent of the owner to occupy the land in question as well as people who took unlawful occupation from the outset.]]></description>

            <description><![CDATA[Earlier this month, the High Court in Pretoria ordered the arrest of Sudanese President Omar Al-Bashir. President Al-Bashir visited South Africa to attend the African Union (AU) Summit on Saturday, 13 June 2015. On Sunday, 14 June 2015, the court heard an urgent application brought by the South African Litigation Centre (SALC) in which the South African government was required to arrest him because it is a party to the Rome Statute. A warrant for President Al-Bashir’s arrest, issued by the International Criminal Court (ICC) in March 2009, was for various crimes against humanity involving pillaging, murder, extermination, forcible transfer, torture and rape against thousands of civilians in Darfur. Thereafter a second warrant for his arrest was issued by the ICC for the crime of genocide.]]></description>
