[1]  This is an application for an extension of the period of suspension of the declaration of invalidity, following this Court’s decision in Women’s Legal Centre Trust v President of the Republic of South Africa.[1]  On 28 June 2022, this Court handed down an order that declared the Marriage Act[2] and the Divorce Act[3] inconsistent with sections 9, 10, 28 and 34 of the Constitution, in that they fail to recognise marriages solemnised in accordance with Sharia law (Muslim marriages).  This Court also declared sections 6, 7(3) and 9(1) of the Divorce Act inconsistent with the Constitution.
