The Democratic Alliance's (DA's) intervention in the "state capture" report court case is to ensure that President Jacob Zuma and Local Government and Traditional Affairs Minister Des Van Rooyen do not abuse judicial processes to shield themselves from possible adverse findings, the party has said.

The DA filed its founding affidavit on the matter on Monday, DA leader Mmusi Maimane said, calling the case a matter of significant public importance.

"As the complainant in the state capture probe, the DA plainly has a direct and substantial interest in whether and when the 'final report' into state capture is released."

Opposing the interdict to prevent the release of the report, the DA argues that the president and minister's interdict amounts to interference with the functioning of an organ of the state "and is inconsistent with the doctrine of the separation of powers".

"President Zuma cannot be allowed to place himself above the law, therefore the release of the final report is a leap toward ensuring he faces the full might of the law and is held accountable," Maimane said on Tuesday.

They were prepared to challenge the matter until "justice prevailed", the DA said.

Former Public Protector Thuli Madonsela handed the contentious report to Parliament for safekeeping after Van Rooyen and Zuma applied for an interdict to prevent its release last week.

Van Rooyen's application was heard by the North Gauteng High Court in Pretoria and will be continued on November 1 along with the president's.

Parliament returned the report to the Public Protector's office on Monday.
