Trade union Solidarity today took action and filed court documents against the Health Department and the Health Minister on behalf of its member. The case will be heard in the High Court on 11 July.

This follows after the Department and the Minister of Health has failed to respond to Solidarity’s urgent request that the graduated nurse, Dané Hertz, who has not been placed in a community service post since January 2017, should be placed in such a post within seven days.

According to Anton van der Bijl, head of the Solidarity Centre for Fair Labour Practices, the Minister and/or the Health Department are required by law to place Hertz. “If she is not placed to complete her one year of compulsory community service, it will not be possible for her to register as a professional nurse,” Van der Bijl said.

Van der Bijl argued that the urgent application was necessary because the final cycle for the 2016/2017 placements had already been finalised by 9 June. “The longer Hertz’s placement is delayed, the longer she will be denied an income and promotion,” Van der Bijl added.
