Introduction

[1] The applicant, in these proceedings, claims that her dismissal by the respondent was automatically unfair based on the alleged breach of the provisions of the Protected Disclosure Act (“PDA”).[1]

[2] The respondent does not dispute the dismissal but contends that it was not for the alleged contravention of the PDA but that it was a dismissal based on incompatibility on the part of the applicant.
