Imminent proclamation of the Labour Relations Amendment Act 6 of 2014

Werksmans Attorneys has received preliminary correspondence suggesting that the President of the Republic of South Africa will issue a proclamation on 19 December 2014 which will set the effective date of the Labour Relations Amendment Act 6 of 2014 (“amendment act”) as 1 January 2015.

The amendment act promises to introduce significant amendments impacting upon, among others, the rights of non-representative unions, disputes regarding organisational rights, picketing, the enforceability and review of arbitration awards, dismissals for operational requirements and the regulation of non-standard employment.
