Judgment reserved in State capture application

The crux of President Jacob Zuma's argument against implementing the remedial action of the Public Protector's State of Capture report is that it would be unconstitutional to do so.

Yesterday Advocate Ishmael Semenya SC, for Zuma said in the High Court in Pretoria that the Public Protector "does not enjoy the power under the Constitution of telling Zuma to establish an inquiry and that the Chief Justice will appoint the judge".

The DA is also seeking a declaratory order that Zuma's conduct in delaying the establishment of the commission is unconstitutional.

 

ANC to fight High Court conference ruling at Supreme Court of Appeal

ANC leadership in KwaZulu-Natal has resolved to challenge the High Court’s ruling by filing an intention to appeal at the Supreme Court of Appeal on Wednesday pending permission from national leadership.

The ruling handed down on Tuesday nullified the legitimacy of the ANC's 2015 provincial elective conference.

Provincial spokesperson Mdumiseni Ntuli said that if the only issue was that the PEC should not have taken place six months earlier, this did not warrant the conference being set aside.

Ntuli said that the judges had not considered the fact that the ANC was a political party and that they had to take into account other factors other than the law.

 

City of Jo'burg rejects secret-ballot vote of no confidence in Mashaba

The DA coalition-led City of Johannesburg yesterday rejected a request to conduct the vote of no confidence in Mayor Herman Mashaba via secret ballot, saying the request was in conflict with the council’s standing rules.

In a statement yesterday afternoon, mayoral committee member for development planning Funzela Ngobeni said the city’s council rules make no provision for a secret ballot and require all votes to be open.

He said the council rules also did not afford the speaker the authority to call for a secret ballot.
