Chief Justice Mogoeng Mogoeng will only get involved in a judicial commission of inquiry into "state capture" if President Jacob Zuma asks him to do so.

In a carefully worded statement from his office, Mogoeng said he does not have a constitutional obligation to initiate the process of appointing a judicial commission of inquiry.

He said the remedial action put forward by former Public Protector Thuli Madonsela only applied to the president.

The chief justice's office said the president can either decide to comply with the remedial action as set out by Madonsela or challenge it on review.

 

President Jacob Zuma says the Helen Suzman Foundation and Freedom Under Law application to force him to suspend National Prosecutions head Shaun Abrahams is based on speculation and conjecture.

Zuma filed an affidavit saying the matter is not urgent and instead said they should allow him time to decide whether Abrahams and two other senior National Director of Public Prosecutions advocates should be suspended.

Zuma wrote to Abrahams and advocates Sibongile Mzinyathi and Torie Pretorius on Tuesday asking them to provide written submissions as to why they should not be suspended. Zuma said their time to respond had not yet expired.

 

The Democratic Alliance will be reporting State Security minister David Mahlobo to the Public Protector for "lying about his relationship" with student leader Mcebo Dlamini.

DA deputy chief whip Mike Waters said Mahlobo deliberately mislead Parliament and the public when he said that Dlamini had never been to his house.

Three days earlier, the minister had said on tape that Dlamini had been to his house a number of times.

It was up to the new public protector to take the minister to task for "fibbing to Parliament", Waters said.
