The hand over brings to an end a process that has taken over two years to bring about consensus on the development of a Charter that will guide the BEE activities in the broadcast, electronics, and information technologies and telecommunications industries.
According to the department, the draft charter draws extensively from the Draft Codes of Good Practice currently being finalised by the Department of Trade and Industry. "Once the draft Codes of Good Practice are finalised, consequential amendments will be made to the Draft ICT BEE Charter so as to ensure alignment and harmonisation," the department said in a statement.
Among other things the charter allocates 20% of the overall scorecard to black equity, and sets a target of 30% of black ownership. This final Draft Charter is submitted to Government for consideration and publication as a sector Code of Good Practice in terms of section 9 of the Broad-Based Black Economic Empowerment Act 53 of 2003. Section 9(5) of the Act requires that the Minister publish the Draft Charter in the government gazette and grant interested persons a period of at least 60 days to comment.
At a workshop held at NEDLAC on November 9, 2004, participants agreed that the final document adopted by the ICT Working Group in October 2004 would be used as a base document for the finalisation of the ICT BEE Charter.
An all-inclusive ICT Charter Steering Committee comprising representatives from Labour, Community, ICASA, Government, Industry Representatives from IT, Electronics, Telecommunications and Broadcasting and representatives of the Working Group was established.
