Madonsela in final push to conclude cases as end of term looms

With 14 days left until Public Protector Thuli Madonsela has to vacate the office and make way for a successor, she says she and her staff are in a race against time to finalise a few reports, including one on state capture.

"Today marks exactly 14 days before the end of my non-renewable seven year term of office and, naturally, my team and I are racing against time to finalise several cases that the people of South Africa have entrusted us with," Madonsela told reporters in Pretoria on Tuesday.

"Contrary to popular belief, the workload that remains to be dealt with in the next two weeks is a mixed bag of cases that involve ordinary people as well as the so-called high-profile cases."

Madonsela said some of the matters they were racing against time to finalise included an investigation into the RDP system. She said an interim report had been released earlier leaving them with the final report into the matter to work on.

"We also released an interim report on the millennium development goals where we were doing a systematic investigation focusing on health and poverty. We are now finalising the final report. We also conducted a systematic investigation on the illegal conversion of panel vans - that too is being finalised," she said.

Madonsela added that there were a few high-profile cases that also needed to be dealt with, including one relating to the funeral of former president Nelson Mandela. There was also another report looking into the conduct of Mandela's administration.

Not an apartheid investigation

"We are finalising a report called CX. It is a report involving the conduct of the first democratic government when it received a report from an organisation called CX. We are finalising Hlasela 2, Prasa 2, Freedy Dairy Farm. We also have reports that are not being finalised that are in the process of being dealt with; and one of these deals with allegations of impropriety including corruption at Sassa. Lastly we are also in the process of finalising a report into alleged state capture," she said.

Commenting on the CX report, she welcomed the interest in it but questioned how people managed to link it to state capture. She said her office was not investigating what happened during apartheid as it had no authority to do so.

"[We are] reviewing the conduct of the government of President Mandela on the receipt of the so-called CX report. We are just looking at whether or not that conduct was proper or could constitute maladministration," Madonsela said.

She said the government had commissioned an investigation which was to be conducted by a company called CX, headed by a former member of the UK's MI5.

"We have made headway in that investigation and have interviewed virtually everyone who needed to be interviewed. An advanced draft of the report is being quality assured," she said.
