The Freedom of Expression Institute is exceedingly disconcerted by the
series of occurrences involving the SABC, including the banning of radio
and TV political advertisements and the violation of the right to
personal privacy through alleged staff surveillance. The FXI views the
arbitrary banning of the advertisement through vague interpretation of
the prescribed electoral regulations and the use of the draconian
National Key Points Act as insouciant acts of blatant censorship. The
FXI condemns the political interference that is clearly the root cause
of the confusion at the SABC.

Public media has the duty to inform the public about matters relevant to
the elections and in this, political parties or candidates must be
afforded the opportunity to campaign on a fair and non-discriminatory
basis.  The decision not to broadcast the advert and the reasons
advanced for it, would not qualify as fair and non-discriminatory. The
FXI warns that such a decision negatively affects the fulfilment of the
SABC mandate during elections which is to ensure that the public is
informed about relevant electoral matters. We therefore urge ICASA to
act without any further delay and rule in the interest and defence of
freedom of expression during this critical time.

The Institute further condemns the use of the draconian National Key
Points Act (NKPA) to  target and effectively silence journalists from
blowing the whistle on maladministration within the public broadcaster.
The reports of staff communication surveillance are alarming and much
like the NKPA, do not belong in this era of South African democracy. The
ability of the SABC to perform its duty in a balanced and impartial
manner is adversely affected by such instigations. The Institute calls
for an immediate investigation by the Parliamentary Portfolio Committee
on Communications into the motivations and prudence of the decision to
implement such regressive measures on the SABC.

In conclusion, the FXI reminds the SABC management that the obligation
of balance and impartiality is imperative for the advancement of the
South African democracy and should be held in high regard above any
political interest. The principles espoused for the public broadcaster
in the Articles of Association should be observed in promoting and
advancing the fundamental human right to freedom of expression of all
who will participate in this election as enshrined in the national
constitution and Articles 2 and 19 of the International Covenant on
Civil and Political Rights.
