The Judicial Conduct Committee said on Tuesday a bid to impeach Chief Justice Mogoeng Mogoeng has been dismissed.

The complaint included allegations of contempt of court and attempting to defeat the ends of justice, which could be construed as gross misconduct.

The Judicial Service Commission informed Mogoeng on Monday that the complaint against him, brought by Institute for Accountability in Southern Africa director Paul Hoffman, SC, had been dismissed.

A panel of two members decided that the complaint, which related to a speech Mogoeng made in July, should be dismissed in terms of section 15 (2) of the Judicial Service Commission Act, which related to the judicial code of conduct.
 

Kenya's deputy President William Ruto goes on trial at the International Criminal Court on Tuesday. He was charged with co-orchestrating a post-election bloodbath five years ago. The case that will test the stability of a country seen as vital to security in East Africa.

The trials of William Ruto and that of Kenyan President Uhuru Kenyatta, which will start in November, have split public opinion, and witness testimonies of the violence in 2008 that killed more than a thousand peopl, could stir tension.

The cases are also a major test for prosecutors at the decade-old Hague-based ICC, who have had a low success rate and face accusations of focusing on African countries, while avoiding war crimes in other global hotspots.

Kenyatta and Ruto, who won an election in March, are accused of leading their respective ethnic groups to fight each other in violence that followed Kenya's disputed 2007 election, when they were in rival political camps.

Meanwhile, President Kenyatta said the country could be forced to halt cooperation with the International Criminal Court if it requires both him and his deputy to attend hearings in The Hague at the same time.

 

China’s oil and mining minister Stephen Dhieu Dao said on Monday the country would help South Sudan develop a mining sector. China is in talks to lend South Sudan between $1-billion and $2-billion for road, power and agriculture projects.

Speaking at a joint news conference with the Chinese ambassador Ma Qiang, Dao said China will provide $43-million to conduct a geological study to help South Sudan's plans to hand out mining licenses in its search for gold and other metals. However, he gave no further details on the discussed loan.

South Sudan signed a mining law in March to attract foreign investment but officials and mining companies say it would take time to develop the sector because of the lack of almost any infrastructure or geological surveys.
