The People’s Constitution had been tested by fire, and emerged stronger than before, said Dr Mathews Phosa during a diplomatic mission luncheon yesterday.
Phosa, who was speaking to more than 20 Asian ambassadors, said Judge Mogoeng Mogoeng’s recent historical Constitutional Court judgement on the Nkandla matter was an indication that South Africa’s constitution stood firm in the storm and was resilient.
Phosa, a senior member of the ANC, said suggestions that the ruling party could not “do the right thing” because it could be seen to be buckling under pressure from opposition parties were just “a poor excuse”.
His remarks appeared aimed at President Jacob Zuma who had resisted calls to resign after the Constitutional Court last month found that he had “failed to uphold, defend and respect the Constitution”.
The Hawks have welcomed the Pretoria High Court judgment, which dismissed an urgent court application brought by the Helen Suzman Foundation and Freedom Under Law to prohibit Lieutenant General Mthandazo Ntlemeza from leading the Hawks or making any decisions.
Brigadier Hangwani Mulaudzi said the judgment vindicated the fact that the integrity of Ntlemeza was beyond reproach.
The South African Communist Party (or SACP) and the Minister of Justice will today oppose the petition to release Chris Hani’s killer, Janusz Walus.
Minister Michael Masutha applied for leave to appeal the ruling, just two days after the 23rd anniversary of the SACP leader's assassination.
SACP spokesperson, Alex Mashilo, indicated they would also oppose the move.
Judge Nicolene Janse van Nieuwenhuizen dismissed government's bid to appeal her ruling that Walus could be released on parole.
Walus, a Polish immigrant, shot Hani dead in the driveway of his Boksburg home on April 10 1993.
