The Tribunal has confirmed, as an order, a consent agreement in which football agent, Quality Talent Sports (Pty) Ltd (QTS), admits to price fixing and/or trading conditions and agrees to pay a fine.

In terms of the agreement between QTS and the Commission, QTS will pay an administrative penalty of R114 158.84. In addition, the football agent agrees to fully co-operate with the Commission in relation to any prosecutions in the case.

QTS has also agreed, among others, to refrain from engaging in cartel conduct, attending a competition law compliance training programme and rolling out such training materials to employees.

In 2015, the Commission launched an investigation into several companies, including QTS, for fixing prices and/or trading conditions when negotiating transfer fees on behalf of football players and coaches.

The Commission found that from at least 2003, agents had fixed the commission charged to football players and coaches at 10% for negotiating and concluding new contracts, transfer contracts, and renewal contracts with football clubs. The Commission also found that agents had fixed the commission charged to football players and coaches at 20% for negotiating and concluding commercial contracts on their behalf.

Earlier this month, the Tribunal confirmed a settlement agreement between Bidvest Media (Pty) Ltd and the Commission. The sports agency agreed to, among others, pay an administrative penalty of R90 013.17. The agreement related to the same matter.
