COSATU: Implementation of sectoral determination by Department of Labour

The Congress of South African Trade Union in the NW calls on the Department of Labour (DOL) in the NW to enforce the law on all companies and individual employers who are not implementing sectoral determinations, in particular for vulnerable workers who are exploited on a daily basis by employers, such as domestic workers, and the retailers - Three Star Cash and Carry and Supreme Poultry Chicken.

The DOL has done inspections in the retail sector, including Three Star Cash Carry in Rustenburg on 24th June 2014 and Supreme Poultry Chicken in Mafikeng on 30th May 2014. It was found that those companies are not complying in terms of the UIF and the sectoral determinations on the payment of those workers and many other laws that govern the workers.

Since that time until today there has been no improvement or any attempt by any of those companies to correct the mistakes and pay workers what is due to them.

Workers at Supreme Poultry are paid less than R370 since 2011 and we are now in 2014. Three Star Cash and Carry have not been complying with the OHS and UIF laws and the sectoral determination for the wholesale and retail sector between 2010 and Feb 2014.

We call on the DOL’s team to make sure that all those companies comply with all that was expected of them and pay workers what is due to them by Friday 24th October 2014. If they fail to do that we will take mass action against the employer and DOL during a busy day and mobilise communities in December to boycott those big shops.

All individual employers of domestic workers are warned once more that they must stop intimidating and threatening workers for joining a union and demanding to be registered with the UIF. It is their right to be given proof or a copy of contract of employment and labour must protect those workers. Once more we call all those workers who are exploited to call the COSATU office or the COSATU Provincial Secretary now or any time when they are facing those challenges during working hours.
