The Copyright Tribunal yesterday decided on a formula that has to be used to calculate the amount of needle-time royalties due to record companies and performers.

“Considering the fact that record companies and performers of musical works have been entitled to be paid needle-time royalties by, inter alia, broadcasters, since June 2002, there should be great relief in the entertainment industry that at least a formula, has finally been determined,” says Jani Cronje – senior associate at Adams & Adams.

However, Cronje says performers and record companies will, however, not yet see money in the bank.

The matter is far from finalised, as the commencement of the date of payment of needle-time royalties, was not decided by the Copyright Tribunal.

“This particular issue fell outside the scope of the referral to the Copyright Tribunal and will have to be decided by another forum.

“How much to “pay for play” has been decided,” says Cronje. “The date from when payment should occur, remains to be determined. Watch this space.”
